Terms of Use

For iOS users: These Terms are in addition to Apple’s Standard End User License Agreement (EULA), which applies to all apps obtained through the App Store. In case of conflict, Apple’s Standard EULA shall prevail with respect to your use of the Application on Apple devices.

These Terms of Use ("Terms") govern your use of the Memolay mobile application ("Application"), developed and maintained by Tansy Software ("we," "us," or "the Service Provider"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

1. Description of Use

Memolay is a vocabulary learning application that helps users learn Malay words through spaced repetition and flashcards. The Application is offered as a freemium product, providing free core functionality with optional premium features available via in-app purchases and subscriptions.

2. Eligibility

You must be at least 13 years old to use the Application. By using the Application, you confirm that you meet this requirement. If you are under the age of majority in your jurisdiction, you represent that you have obtained consent from a parent or legal guardian.

3. Acceptable Use

You agree to use the Application only for lawful and intended purposes. You must not:

•  Attempt to reverse-engineer, decompile, or tamper with the Application  

•  Bypass access controls or attempt to unlock premium content without proper payment  

•  Upload malicious code or interfere with the performance of the Application  

•  Use automation, bots, or scripts to simulate usage or manipulate the system  

4. User Data and Storage

The Application stores your learning progress and app preferences (e.g., study history, word familiarity levels) locally on your device.

If you sign in with a Google account or Apple account, your subscription may be synchronized across devices.

We take reasonable steps to secure this data, but we cannot guarantee complete security or recovery in the event of:

•  Account loss or unauthorized access  

•  Service outages or data corruption  

•  Improper sign-out or device sync conflicts  

You are responsible for safeguarding your credentials and device. For optimal protection, ensure your Google or Apple account uses a strong password and 2FA.

5. Account and Authentication

The Application supports sign-in via Google account or Apple account. Some features, such as subscription sync across devices, may require a signed-in state to function properly.

You are responsible for maintaining the security of your login credentials. Do not share access to your account with others.

6. In-App Purchases and Subscriptions

The Application offers optional premium subscriptions (monthly, annual, and lifetime) through Google Play and the Apple App Store. By making a purchase, you agree to the respective store’s billing terms and policies.

• All payments are processed securely by Google or Apple; we do not collect or store any payment details.

• Subscriptions automatically renew unless canceled before the end of the billing cycle.

• You may cancel subscriptions at any time through your Google Play account settings or Apple App Store account settings.

• Subscription titles, durations, and prices are clearly displayed within the Application and on the App Store / Google Play purchase screen. Prices may vary by region and are subject to change.

• Refunds and cancellations are handled directly by Apple App Store or Google Play Store according to their respective policies.

7. Intellectual Property

All content within the Application—including but not limited to UI design, app structure, logos, and curated vocabulary datasets—is the intellectual property of Tansy Software unless otherwise indicated.

You may not copy, distribute, modify, or create derivative works of the Application without prior written permission.

8. Third-Party Services

The Application integrates with the following third-party services:

• Google Play Services 

• Google Play Billing  

• Google Sign-In

• Apple In-App Purchases (IAP)

• Apple App Store

• Firebase (Authentication, Firestore, and/or Realtime Database)  

• Amplitude Analytics

These services are used for login, purchase verification, and analytics. Your use of these services is subject to their respective terms and privacy policies.

 9. Limitation of Liability

To the fullest extent permitted by law:

• We provide the Application "as is" without warranties of any kind 

• We make no guarantees regarding the accuracy, reliability, or availability of the Application  

• We are not liable for any indirect, incidental, or consequential damages, including loss of data, subscription issues, or access interruptions  

10. Termination

We reserve the right to suspend or terminate your access to the Application if you violate these Terms or misuse the service. You may stop using the Application at any time.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Application after changes constitutes your acceptance of the revised Terms.
