Terms of Service for MemeMates

Welcome to MemeMates! These Terms of Service ("Terms") govern your access to and use of the MemeMates mobile application and its related services (collectively, the "Service"). Please read these Terms carefully.

By creating an account or by using our Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to create an account on MemeMates and use the Service. By creating an account, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all of its terms and conditions.

2. Your Account

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

3. The Service

MemeMates provides a platform for users to connect through shared interests in memes and humor. The Service allows you to:

• Create and share content, including memes, Mood Boards, and Stories.

• View and interact with content created by other users.

• Connect and communicate with other users through our matching systems (Active Connections, VibeMatch, CommonLike Match) and chat features.

4. User Content

A. Your Responsibility for Your Content You are solely responsible for the content you upload, publish, or display on the Service ("User Content"). This includes memes, text, images, and messages. You agree that you will not post any User Content that is defamatory, obscene, pornographic, abusive, harassing, or that violates any law.

B. Our Rights to Your Content By creating User Content, you grant MemeMates a worldwide, non-exclusive, royalty-free, transferable license to use, host, store, reproduce, modify, display, and distribute your User Content for the limited purposes of operating, developing, providing, and improving the Service.

5. Community Guidelines and Prohibited Conduct

To keep MemeMates a safe and enjoyable community, you agree that you will not:

• Use the Service for any illegal or unauthorized purpose.

• Harass, bully, intimidate, or threaten any other user.

• Post any content that contains hate speech, is threatening, or sexually explicit.

• Impersonate any person or entity, or post content on behalf of any person without their explicit consent.

• Use the Service for any commercial purposes, such as spamming or soliciting users.

• Use any robot, spider, or other automated means to access the Service or scrape data from other users.

Violation of these guidelines may result in the suspension or termination of your account at our sole discretion.

6. License to Use the Service

MemeMates grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to access and use the Service. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by us, in the manner permitted by these Terms.

7. Termination

We may terminate or suspend your account at any time without notice if we believe that you have violated these Terms. Upon termination, you will not be entitled to any refund for any in-app purchases.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEMEMATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

10. Governing Law

These Terms shall be governed by the laws of YOUR LOCALITY, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in YOUR LOCALITY.

11. Changes to These Terms

We may modify these Terms from time to time. We will provide you with notice of any material changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
