# MaxiUp Terms of Use

By downloading, accessing, or using MaxiUp (the “App”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

## 1. The Service
MaxiUp provides features that may generate or present results based on photos you choose to submit (camera or photo library). Results are provided “as is” for informational/entertainment purposes.
## 2. Eligibility
You must be at least 13 years old to use the App.
## 3. Subscriptions and Purchases
- The App may offer paid subscriptions or features.
- Purchases are processed by Apple via In‑App Purchase (IAP). Pricing, billing period, and renewal terms are shown at the time of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your Apple ID account settings.
- If supported in the App, you may use “Restore Purchases” to restore eligible purchases.
## 4. User Content (Photos You Submit)
You represent and warrant that you have the rights and permissions to submit any photos or content you provide to the App, including permission from any individuals appearing in the content where required by law.
You retain your rights in your content, subject to the license below.
## 5. License to Process Your Content
You grant MaxiUp a limited, non-exclusive license to process and transmit your submitted content solely to provide the features you request (including sending the content to service providers used to run the requested processing).
## 6. Prohibited Use
You agree not to:
- use the App for illegal activities;
- submit content that infringes others’ rights;
- attempt to reverse engineer, bypass security, or disrupt the App.
## 7. No Ads
The App does not display ads.
## 8. Third‑Party Services
The App may rely on third-party services (for example, AI processing, analytics, notifications, purchase management). Your use of the App may be subject to those providers’ terms and policies.
## 9. Privacy
Our privacy practices are described in our Privacy Policy: see `PRIVACY_POLICY.md`.
## 10. Disclaimers
THE APP AND RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON‑INFRINGEMENT.
## 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXIUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE APP.
## 12. Changes to the App or Terms
We may update the App or these Terms from time to time. Continued use after changes means you accept the updated Terms.
## 13. Governing Law
These Terms are governed by the laws of your place of residence, unless applicable law requires otherwise.
