Welcome to Loxio

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Loxio ("we," "us," "our," or "Company") regarding your access to and use of the Loxio mobile application (the "App"), our website, and any related services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. BY DOWNLOADING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THE SERVICES.

1. Acceptance of Terms

By creating an account, accessing the Feed, uploading content, or using the "Link Up" feature, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. These Terms apply to all visitors, users, and others who access the Services.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page or through a notification within the App. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

2. Eligibility and Account Registration

2.1. Age Requirement

The Services are intended solely for users who are 16 years of age or older. By using Loxio, you represent and warrant that you meet this age requirement. Providing false information regarding your age is a direct violation of these Terms. 

Protections for Minors (Ages 16-17): If you are between the ages of 16 and 17, your account is subject to mandatory safety guardrails. Your account will be permanently locked to "Private" status, and your real-time location data will be automatically randomized (fuzzed) before being processed by our servers to protect your physical safety. 

2.2. Account Creation

• To access certain features of the App, such as posting content, utilizing the "Link Up" feature, or viewing private profiles, you must register for an account. You may register using your email address or through third-party authentication services (e.g., Google Sign-In, Apple Sign-In).

• Information Accuracy: You agree to provide accurate, current, and complete information during the registration process, including your Date of Birth and a unique username.

• Prohibited Usernames: We reserve the right to reclaim or block usernames that infringe on trademarks, impersonate others, or contain offensive language as determined by our internal profanity filters.

2.3. Account Security

You are responsible for safeguarding your login credentials. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. Loxio utilizes cryptographic device attestation to ensure you are using an official, unmodified version of the App. Attempting to bypass these security checks is prohibited. Loxio is not liable for any loss or damage arising from your failure to comply with these security obligations.

3. Privacy and Data Collection

Your privacy is critical to us. Our use of your personal information is governed by our Privacy Policy.

By using Loxio, you acknowledge and agree that:

• Location Data & Randomization: The core functionality of Loxio requires the collection of your geolocation data. However, if your account is set to "Private" or if you are under 18, we will intentionally randomise (fuzz) your location coordinates before storing them. We do not store your exact GPS coordinates in these cases.

• Metadata Extraction: When you upload media, Loxio processes the file's metadata (EXIF data) to determine the date taken, GPS coordinates, and software modification history to assign a "Verification Status."

• Public Visibility: Unless your account is set to "Private," your posts and approximate location information associated with those posts may be visible to other users nearby.

4. User Generated Content (UGC)

4.1. Ownership

You retain all ownership rights to the photos, videos, text, and captions you post on Loxio ("User Content"). However, by posting User Content, you grant Loxio a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation of the Services.

4.2. Content Verification and Metadata

Loxio utilizes an automated system to categorize User Content based on metadata analysis:

1. Verified Original: Content that contains intact, original GPS and timestamp metadata and shows no evidence of external software manipulation.

2. Processed/Edited: Content that has been identified as modified by third-party software (e.g., Photoshop, Lightroom) or lacks original metadata.

3. Unverified: Content uploaded without sufficient metadata to determine its origin.

You acknowledge that Loxio reserves the right to label your content with these badges publicly. Attempting to spoof, falsify, or inject fake metadata to achieve "Verified" status is a violation of these Terms and may result in account termination.

4.3. Prohibited Content

Loxio is an open and globaly available media platform with your content being visible to the broader public. Thus by using this service you agree not to post User Content that:

• Contains profanity, hate speech, or offensive language (including words blocked by our automated Profanity Filter).

• Is sexually explicit, pornographic, or contains nudity.

• Promotes illegal acts, violence, or self-harm.

• Infringes on the copyright, trademark, or intellectual property rights of others.

• Contains video content exceeding the 60-second duration limit imposed by the App.

4.4. Content Removal

We have the right, but not the obligation, to monitor and review User Content. We verify content through automated systems and user reports. We reserve the right to remove or disable access to any User Content for any reason, including content that violates these Terms or is deemed objectionable by us.

5. The "Link Up" Feature and Social Interactions

5.1. Linking and Privacy

Loxio allows users to "Link Up" with one another.

• Mutual Consent: Linking requires mutual consent. One user must send a request, and the other must accept it via the Notification centre or Inbox.

• Private Content: Linking allows users to bypass "Private Account" restrictions, granting access to private posts, full profiles, and real-time location data (if enabled by the user).

5.2. Messaging

Once Linked, users may exchange text and image messages. You agree not to use the messaging service to harass, stalk, spam, or send unsolicited advertisements to other users.

5.3. Blocking and Reporting

You may block other users at any time via their Profile settings. Blocked users will not be able to see your posts, message you, or request to Link Up. You may also report specific posts or users for violating these Terms. Misuse of the reporting system to harass others is prohibited.

6. Location Services and Augmented Reality (AR)

6.1. Location Dependency

Loxio is a location-based service. You acknowledge that the App functions primarily by tracking your physical location. If you disable Location Services on your device, significant features of the App (including the Feed, Map, and Post creation) will not function.

6.2. Augmented Reality (AR) Safety Warning

The "AR Feed" feature overlays digital content onto the physical world viewed through your device's camera.

• Be Aware of Your Surroundings: You explicitly agree to remain aware of your physical surroundings while using the AR features. You agree not to use the AR Feed while driving, walking in traffic, operating heavy machinery, or in any unstable or unsafe environment.

• Assumption of Risk: You assume all risks associated with your movement in the physical world while interacting with the App. Loxio is not liable for any injury, death, or property damage that results from your use of the AR features.

6.3. Accuracy Disclaimer

Maps, directions, and location-based information depend on data provided by third parties and your device's GPS hardware. Due to our deliberate privacy fuzzing features and hardware limitations, Loxio does not guarantee the accuracy, completeness, or timeliness of location data.

7. Loxio Score and Ranking System

7.1. Scoring Mechanism

The App assigns a "Loxio Score" and associated "Rank Badges" to users based on an automated algorithm. This score is calculated based on factors including, but not limited to:

7.2. No Monetary Value

The Loxio Score and Rank Badges are purely for entertainment and social status within the App ecosystem. They have no cash value, cannot be redeemed for currency, and are not transferable to other accounts or third parties.

7.3. Manipulation

Any attempt to artificially inflate your Loxio Score through the use of bots, scripts, fake accounts, coordinate spoofing, or organized "engagement farming" groups is strictly prohibited and will result in a permanent ban and the resetting of your score.

8. Intellectual Property Rights

8.1. Company Intellectual Property

The Loxio App, including but not limited to its source code, database structures, algorithms (including the Loxio Score and verification algorithms), user interface design, "HexAvatar" visual concepts, graphics, logos, and the "Loxio" trademark, are the exclusive property of Loxio and its licensors. These are protected by copyright, trademark, and other intellectual property laws.

8.2. Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial use on a device that you own or control, strictly in accordance with these Terms. You may not reverse engineer, decompile, or attempt to extract the source code of the App.

9. Third-Party Services and Advertisements

9.1. Advertising

The App is supported by advertising revenue. By using the App, you agree that we may place advertising and promotions on the Service, including within the Feed as "Native Ads" (image or video) interspersed with User Content.

• Ad Providers: We use Google AdMob and other third-party networks to serve advertisements.

• No Endorsement: The presence of an ad does not imply endorsement by Loxio. We are not responsible for the content, products, or services offered by third-party advertisers. Your interactions with advertisers found on Loxio are solely between you and the advertiser.

9.2. Third-Party Authentication

Loxio allows you to sign up and log in using third-party services, including but not limited to Google Sign-In, Apple Sign-In, and Microsoft Login. By using these features, you authorise us to collect authentication information (such as your email address and unique user ID) from these providers in accordance with our Privacy Policy.

9.3. Maps and Geocoding

Loxio utilizes Apple MapKit and Core Location services to provide map interfaces and reverse geocoding (translating coordinates into place names). Your use of these map features is subject to Apple’s additional terms of use and privacy policies.

10. Prohibited Activities

In addition to other restrictions outlined in these Terms, you agree that you will not:

1. Metadata & Location Manipulation: Attempt to modify, spoof, or inject falsified EXIF/GPS data into images, or use location spoofing software on your device.

2. Reverse Engineering: Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services, specifically the scoring or verification logic.

3. Automated Use: Use any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Services or to extract data.

4. Age Fraud: Falsify your Date of Birth to bypass age restrictions or underage safety guardrails.

5. Security Breaches: Attempt to bypass any security or authentication measures, including the "Private Account" restrictions or blocking features.

6. Profanity Evasion: Attempt to bypass the automated Profanity Filter by using misspellings, special characters, or alternative formatting to post banned words.

7. Harassment: Use the "Link Up" or Messaging features to harass, threaten, or intimidate other users.

8. Server Overload: Interfere with or disrupt the Services or servers (e.g., DDoS attacks) or place an undue burden on the App's infrastructure.

9. Stalking or invasion of Privacy: Use of the apps intergrated location features to invade the bounds of user privacy to stalk, track, or monitor the other users within the Loxio ecosystem for personal or malicious reasons.

11. Termination and Data Deletion

11.1. Termination by You (Strict Hard-Delete Policy)

You may terminate your account at any time by visiting the "Danger Zone" in the Settings menu and selecting "Delete Account." 

Loxio enforces a strict "hard delete" policy. Upon requesting account deletion, your user profile, all uploaded media (photos and videos), chat images, direct messages, feed posts, and friend links are permanently and irreversibly destroyed from our active databases and storage buckets. We do not soft-delete, hide, or retain deactivated copies of your data.

11.2. Termination by Us

We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Specifically, repeat violations of the Content Policy or manipulation of the Loxio Score will result in a permanent ban.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOXIO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SPECIFICALLY, WE DO NOT WARRANT THAT:

• LOCATION DATA IS ACCURATE: GPS TECHNOLOGY IS SUBJECT TO INTERFERENCE AND HARDWARE LIMITATIONS. WE DO NOT GUARANTEE THE PRECISION OF THE "NEARBY" FEED OR USER LOCATIONS.

• VERIFICATION IS PERFECT: WHILE WE USE ADVANCED METADATA ANALYSIS, THE "VERIFIED" STATUS BADGE IS NOT A GUARANTEE OF ABSOLUTE AUTHENTICITY.

• AR FEATURES WILL FUNCTION: AUGMENTED REALITY PERFORMANCE DEPENDS HEAVILY ON YOUR DEVICE HARDWARE AND LIGHTING CONDITIONS.

• THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LOXIO, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;

2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;

3. ANY CONTENT OBTAINED FROM THE SERVICES;

4. PHYSICAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE AR OR LOCATION FEATURES.

14. Indemnification

You agree to defend, indemnify, and hold harmless Loxio and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

15. Apple App Store & Google Play-store Provisions

Because you are downloading the App from the Apple App Store, the following terms apply:

1. Acknowledgement: These Terms are between you and Loxio only, not Apple. Loxio is solely responsible for the App and its content.

2. Maintenance: Apple has no obligation to furnish any maintenance and support services with respect to the App.

3. Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligation whatsoever.

4. Claims: Loxio, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims and intellectual property infringement claims.

5. Legal Compliance: You represent that you are not located in a country that is subject to a U.S. government embargo or designated as a "terrorist supporting" country.

6. Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and will have the right to enforce them against you.

16. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Loxio is headquartered, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. You waive any right to a jury trial or to participate in a class action lawsuit.
