民國廿七年（1938）後，國民政府各機關在林森的領導下，堅持抗戰。民國廿九年（1940）三月廿二日，汪精衛偽政權成立時，為表示繼承法統、聲明「政府主席」仍由林森擔任，汪精衛代理。此舉遭林森嚴厲痛斥。卅二年（1943）八月一日，林森在重慶車禍不治。
