Commonwealth Code of Justice
INTRODUCTION
The laws of the Communauté can be broken down into three: Minor, moderate, and major offense charges. The lawbook of Madsen confines laws of different severities into these levels of punishment to provide fair justice to all citizens and visitors of Madsen.
A Citizen of the Commonwealth is a legally recognized member of the Communauté de Windernola, entitled to its rights, privileges, and protections, and subject to its laws and duties. There are three classes of Citizens within the Communauté:
Rights of the Citizen
Being a natural-born offspring of a Citizen of Madsen, or having completed a period of probationary citizenship and passing an interview with an authorized official of Madsen, entitles you to:
Right to Equality – All persons are created free and equal in dignity and rights.
Freedom from Discrimination – No one should face discrimination based on race,gender, etc.
Right to Life, Liberty, and Security – Everyone has the right to live freely and safely.
Freedom from Slavery – No one shall be held in slavery or servitude.
Freedom from Torture and Unjust Treatment – No one shall be subjected to torture or cruel punishment.
Right to Recognition Before the Law – Everyone is equal before the law.
Right to Equal Protection Under the Law – The law must be applied fairly to all.
Right to Fair Legal Recourse – Access to justice for violations of rights.
Freedom from Arbitrary Arrest & Detention – No one can be arrested without legal justification.
Right to a Fair Trial – Everyone is entitled to an impartial trial.
Presumption of Innocence – Innocent until proven guilty.
Right to Privacy – Protection from arbitrary interference in personal life.
Freedom of Movement – Right to travel, leave, and return to one's country.
Right to Nationality – No one can be arbitrarily denied their nationality.
Right to Marry and Found a Family – Freedom to choose a spouse and have a family.
Right to Own Property – Individuals can own property without unjust seizure.
Freedom of Thought, Conscience, and Religion – Right to belief and worship freely.
Freedom of Expression – Right to share opinions without censorship.
Freedom of Assembly and Association – Right to peaceful protest and organization.
Right to Participate in Government – Includes voting and political involvement.
Right to Social Security – Access to essential social protections.
Right to Work & Equal Pay – Fair wages, safe working conditions, and no forced labor.
Right to Rest and Leisure – Reasonable working hours and paid holidays.
Right to an Adequate Standard of Living – Access to food, clothing, housing, and healthcare.
Right to Education – Free and compulsory elementary education.
Right to Participate in Cultural Life – Access to arts, sciences, and cultural contributions.
Duties to the Community – Responsibilities to respect others’ rights and freedoms.
Freedom from State or Personal Interference in Rights – No one can take away these rights.
2. Non-Citizenship
All people within Madsen, regardless of Citizenship, are entitled to:

A. Infractions
Infractions may be punished by a fine that does not exceed $5 ND, service to the community, and/or an overnight detention.
A person who commits any of the acts listed below or acts similar shall be guilty of an Infraction:
Vandalism, petty;
Theft, petty;
Threatening an individual with an act of violence;
Taking photography of active duty members of the Bureaucracy or Martial Branch;
Concealed carrying of blades or arms;
Trespassing;
Disturbing the peace;
Public intoxication;
Possession of fraudulent identification;
B. Misdemeanors
Misdemeanors may be punished with temporary detention, service to the community, or a temporary and/or a severe fine not exceeding $15 ND.
A person who commits any of the acts listed below or acts similar shall be guilty of a Misdemeanor:
Repeated Infractions;
Theft of property, civil;
Vandalism, destructive;
Trafficking of abusive and harmful substances;
Trafficking of contraband or outlawed items;
Lying to an enforcer of the law;
Con artistry and fraudulent monetary practices;
Repetitive trespassing;
Identity fraud;
Brawling or assault and battery, nonlethal;
Assaulting an enforcer of the law;
Discrimination of any kind, for moral, religious, or personal reasons;
Bribery of a government official;
Harmful or fraudulent business practices;
Manslaughter.
C. Felonies
Felonies shall be punished by mandatory service to the community, a permanent exile from Madsen, or by execution.
A person who commits any of the acts listed below or acts similar shall be guilty of a Felony:
Repeated Misdemeanors;
Murder, committed or attempted;
Theft of property, government;
Hiding an eldritch mutant from the law;
D. Atrocities
An Atrocity shall result In punishment by execution.
A person who commits any of the acts listed below or acts similar shall be guilty of an Atrocity:
Treason;
Inciting violence or civil unrest with the intention of destabilizing the government;
Cruel and unusual or politically motivated acts of murder;
Acts of terrorism.
A. Taxes shall be allocated in the following manner:
Commercial Goods
5%
Property Owned
10%/annum
Wealth above 30ND
2%/annum
Income
10%
B. In times declared as an emergency by the higher echelon, rationing may be implemented at the discretion of relevant officials of Madsen.
C. Property Ownership:
A. All buildings and market stalls located in Madsen are subject to Commonwealth law and Commonwealth taxes.
B. If the Commonwealth deems it necessary, groups of people or individuals are legally obliged to be evicted from specific buildings in Madsen.
C. All buildings and market stalls in Madsen (except for government buildings) must be rented by their owners. Every Friday the property owners must pay a 1.50ND tax. If property owners refuse to pay their taxes they are subject to a moderate offense charge, and if necessary, the property may be shut down and its inhabitants evicted.
D. Property owners are required to maintain their properties. If their properties are deemed to be inhabitable or unsafe the property owners are subject to a moderate offense charge.
E. All vessels docked at Madsen’s dock are subject to searches.
D. Weapon Ownership:
Citizens and visitors of Madsen are permitted to carry firearms and bladed weapons in Madsen, however they must be holstered and put away at all times. If someone has a firearm in their hands without reason the firearm is subject to confiscation and the offender will be charged with a moderate offense. Bladed weapons may be out for show if the person showing off the weapon is being observed by a member of the Commonwealth.
A. It is illegal for anyone under the age of 18 to carry a firearm within Madsen. If someone under 18 is caught with a firearm the offender’s parents are subject to a moderate offense charge.
B. Citizens and visitors of Madsen are able to legally defend themselves if they are under attack. If being attacked with a weapon, the defender is automatically permitted to defend themselves with their own weapon.
C. It is illegal to help Commonwealth law enforcement with a weapon. If a citizen or visitor wants to help law enforcement they must do it with their bare hands, unless the enforcer is in immediate danger of being significantly injured with an attacker’s weapon.
D. It is rare to happen, but it is legal for the citizens and visitors of Madsen to arm themselves and fight alongside Commonwealth forces in the event of an invasion. This includes eldritch breaking into the settlement.
