By joining any KL Hiking activity, each participant acknowledges that they have read, understood and agreed to the terms and conditions set out below.
Participation in our activities involves inherent risks, including the risk of injury, illness, accident, loss, damage to personal property or, in extreme circumstances, death. To the extent permitted by law, participants agree to release and hold harmless the organisers, co-organisers, assistants, hosts and other participants from liabilities and claims arising from their participation in the activity.
If a participant brings a minor or has a minor under their care during an activity, the participant accepts full responsibility for the minor's safety, conduct and supervision. The organisers, hosts and assistants shall not be responsible for supervising the minor.
Participants must arrive at the specified meeting point at least 15 minutes before the announced meeting time.
If a participant is absent at the specified meeting point at the agreed date and time, the organisers are not required to wait and may proceed with the activity without the participant.
For the purposes of these terms, "organisers" includes co-organisers, assistants and hosts.
The organisers may work with or appoint local organisers, guides, hosts, operators or other third parties to assist with arranging or conducting an activity. These may be based in Malaysia or at the destination of an overseas activity ("Local Organisers").
Local Organisers may make reasonable changes to the itinerary, route, timing, meeting arrangements or programme where circumstances require or where they consider such changes necessary for operational, logistical or safety reasons.
The organisers shall not be responsible for changes, cancellations or delays resulting from circumstances beyond their reasonable control, including decisions or actions of Local Organisers, accidents, strikes, government regulations, weather conditions, natural disasters or other unforeseen circumstances.
Where the organisers become aware of a significant change that materially affects the activity, we will make reasonable efforts to inform participants as soon as practicable.
Where payment is required, payments are non-refundable unless otherwise stated in the specific event's cancellation policy.
For certain events, a participant may be permitted to arrange for a replacement. The participant is entirely responsible for finding a suitable replacement. Any replacement must be approved by the organisers, and approval is at the organisers' discretion.
For overseas trips, each participant is responsible for determining and fulfilling, in a timely manner, all immigration and entry requirements applicable to their nationality and the destination concerned, including visas, permits and other required documentation.
The organisers shall not be responsible for consequences arising from a participant's failure to obtain or carry the required documentation.
Participants are strongly advised to obtain comprehensive travel insurance appropriate to the activity and destination, including suitable coverage for medical emergencies, personal accidents, evacuation, natural disasters and other relevant risks.
Where requested, participants should provide their insurance agency/company details, policy number and 24-hour emergency contact number before the trip commences.
Participants acknowledge that adventure activities involve inherent and sometimes unpredictable risks.
During an activity, circumstances may arise including, but not limited to, accidents, illness, injury, adverse weather, natural hazards, political instability or other unforeseen events.
By participating, each participant acknowledges these risks and agrees to accept responsibility for the risks associated with their participation and, to the extent permitted by law, to indemnify the organisers and hosts against claims arising from the participant's own actions or participation.
As our activities involve varying levels of physical and environmental challenge, the organisers reserve the right to refuse or discontinue a participant's participation if they consider the participant unsuitable for the activity or if participation may pose a safety risk to the participant or others.
By confirming participation, submitting a Participation Form and/or making payment, the participant confirms that they have read, understood and accepted these terms and conditions.
The participant acknowledges that the organisers' role is subject to an obligation of means and not an obligation of result. The organisers will take reasonable measures in organising and conducting activities but cannot guarantee any particular outcome or that an activity will be free from risk.
Personal information provided by participants will be used only for purposes connected with organising and conducting activities, including:
preparing participation lists;
applying for permits or approvals where necessary; and
responding to emergencies or other situations where the information is reasonably required.
We will not disclose personal information to third parties for unrelated purposes, except where required or permitted by law or where necessary for the purposes described above.
Please note that certain information, such as a participant's name, nationality, hiking level and attendance history, may not be considered confidential or sensitive information and may be mentioned or shared in the course of organising activities or communicating with participants and involved parties.
Participants who do not wish certain non-sensitive information to be mentioned or shared should inform the organisers in advance in writing.
We take reasonable measures to protect participant information against unauthorised access, disclosure, alteration or loss.
Personal information is stored using appropriate security measures and access controls. Access to participant information is limited to authorised persons who require it for legitimate organisational purposes.
No method of electronic storage or transmission can be guaranteed to be completely secure. Participants acknowledge this inherent limitation when providing information electronically.
