# Terms of Service

These Terms of Service (“Terms”) govern your access to and use of **JoyClip AI** and related services (collectively, the “Service”) provided by us (“we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Our [Privacy Policy](privacy-policy.md) explains how we handle personal information. Paid subscriptions, virtual credits, and billing details are further described in our [Subscription Terms](subscription-terms.md). If there is a conflict regarding subscriptions or in-app purchases, the **Subscription Terms** control for those matters.

## 1. Eligibility
You must be at least **13 years old** to use the Service.
If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who accepts these Terms on your behalf.

## 2. What the Service Provides
JoyClip AI offers AI-assisted creative tools, including but not limited to:
- AI video generation from text, images, or other inputs
- Video editing, enhancement, and style transformation
- Related features that may be added, changed, or removed over time
The Service uses **anonymous access** (no registration or third-party login). Some features require a network connection, cloud processing, a paid subscription, consumable in-app purchases (such as credits), or viewing advertisements. Availability may vary by device, region, and app version.

## 3. User Content
### 3.1 Your Ownership
You retain ownership of content you upload, submit, or generate through the Service (“User Content”), subject to third-party rights in any materials you include.
### 3.2 License You Grant Us
To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display your User Content **solely** to:
- Provide the features you request
- Maintain security, prevent abuse, and enforce these Terms
- Comply with applicable law
This license ends when your User Content is deleted from our systems, except for reasonable backup or legal retention periods.
### 3.3 AI Processing
- User Content is processed to fulfill your specific requests.
- We do **not** use your uploads to train general-purpose AI models for the benefit of other users.
- Processing may involve third-party cloud and AI infrastructure providers acting on our instructions.

## 4. Acceptable Use
You agree **not** to use the Service to create, upload, share, or promote content that:
- Violates any applicable law or regulation
- Is sexually explicit, pornographic, or exploits minors in any way
- Depicts or promotes violence, terrorism, self-harm, or harassment
- Infringes intellectual property, privacy, or publicity rights
- Impersonates others or is fraudulent or misleading
- Contains malware or attempts to disrupt or access systems without authorization
We may investigate violations and suspend or terminate access, remove content, or report activity to authorities where appropriate.

## 5. Anonymous Access and Security
JoyClip AI does not provide user accounts, passwords, or third-party login. Access is **anonymous** and associated with your device and app-generated identifiers.
You are responsible for:
- Securing your device and Google Play account used for purchases
- Activity on your device while using the Service
Notify us at **help@aijoyclip.net** if you believe someone has misused the Service or your paid entitlements.
We may restrict access tied to a device or identifier for security risks, policy violations, fraud, or chargebacks.

## 6. Subscriptions, In-App Purchases, and Advertising
### 6.1 Paid Features
Certain features require a **subscription** and/or **in-app purchases** (such as virtual credits). Prices, billing periods, and trial offers are shown in the app and on Google Play at the time of purchase.
### 6.2 Google Play Billing
All payments are processed by **Google Play**. Subscriptions **renew automatically** unless you cancel before the renewal date through your Google Play account settings.
**Free trials**, if offered, convert to a paid subscription at the displayed price unless you cancel at least **24 hours** before the trial ends (or as otherwise stated at purchase).
**Cancellation** stops future charges; access generally continues until the end of the current billing period. Uninstalling the app does **not** cancel a subscription.
**Refunds** are handled under **Google Play’s** refund policies. We do not process payment card charges directly.

### 6.3 Advertising
The free or ad-supported experience may display third-party advertisements (for example, through Google AdMob). Ad serving may use device identifiers as described in our Privacy Policy.

## 7. Intellectual Property
Except for User Content, we and our licensors own the Service, including software, branding, interfaces, and underlying technology. You receive a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, or reverse engineer the Service except where such restrictions are prohibited by law.
References to “AI systems” do not transfer ownership of third-party models or APIs integrated into the Service.

## 8. Third-Party Services
The Service relies on third parties (cloud providers, AI APIs, analytics, advertising networks, Google Play). We are not responsible for third-party products, sites, or terms. Your use of Google Play is subject to Google’s terms and policies.

## 9. AI Output Disclaimer
AI-generated videos and other outputs may be inaccurate, incomplete, offensive, or unexpected. Outputs are for **entertainment and creative purposes only**. They are not professional, legal, medical, or financial advice. You are responsible for reviewing outputs before sharing or relying on them.

## 10. Termination
You may stop using the Service at any time.
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by nature should survive (including disclaimers, limitations, and dispute resolution) will survive termination.

## 11. Disclaimers
THE SERVICE IS PROVIDED **“AS IS”** AND **“AS AVAILABLE.”** TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted operation, error-free AI results, or that outputs will be unique or free of third-party claims.

## 12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL.
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US THROUGH GOOGLE PLAY IN THE **12 MONTHS** BEFORE THE CLAIM OR (B) **USD $50**.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

## 13. Indemnity
You agree to defend and indemnify us against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, except where caused by our gross negligence or willful misconduct.

## 14. Changes to These Terms
We may update these Terms. The “Last Updated” date will change when we do. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional notice or consent.

## 15. Governing Law and Dispute Resolution
### 15.1 Governing Law
These Terms are governed by the laws of the **Hong Kong Special Administrative Region** (“Hong Kong”), without regard to conflict-of-law rules, except that mandatory consumer protection laws in your country of residence may still apply.
### 15.2 Informal Resolution
Before starting legal proceedings, you agree to contact us at **help@aijoyclip.net** and allow **30 days** to try to resolve the dispute informally.
### 15.3 Courts
If the dispute is not resolved informally, you and JoyClip AI agree to submit to the **exclusive jurisdiction of the courts of Hong Kong**, except where applicable law requires that a consumer may bring proceedings in the courts of the consumer’s place of residence.
