Force majeure means the occurrence of an event that is beyond Inspiring Vacation’s reasonable control and which could not have been reasonably prevented by Inspiring Vacations.
APPLICABLE SCENARIOS
Scenarios are as below but is not limited to:
Conflict & Civil Unrest
War, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity, or the threat of such acts.
Natural Disasters & Extreme Weather
Flooding, fire, earthquake, landslide, adverse weather conditions, high or low water levels.
Environmental & Industrial Accidents
Nuclear or other industrial accidents causing environmental pollution or contamination.
Public Health Crises
Epidemics, pandemics, quarantines, or any other public health crises, including COVID-19 and its variants.
Supplier Insolvency or Business Failure
The administration, liquidation, or operational failure of a travel supplier (airline, cruise, tour operator) affecting the package.
Legal or Regulatory Changes
Enactment, amendment, or repeal of laws impacting travel, including:
Statutes, regulations, by-laws, declarations, licenses.
Common law updates.
Travel or movement restrictions imposed by state, federal, or foreign governments.
If Inspiring Vacations, in its reasonable opinion, considers that any Force Majeure event prevents Inspiring Vacations (whether directly or indirectly through its employees, contractors, subcontractors and agents) from lawfully or safely providing any products or services subject to the booking contract with you, Inspiring Vacations may immediately by written notice:
TERMINATION OF BOOKING CONTRACT
Inspiring Vacations may terminate your booking contract, either in whole or in part.
MODIFICATION OF TRAVEL ARRANGEMENTS
Inspiring Vacations may alter your travel plans as reasonably practicable to ensure your safety.
Any additional costs incurred due to these changes will be invoiced to you.
PARTIAL CREDIT ISSUANCE
Customers may receive a partial credit for their booking.
DEDUCTIONS FOR THIRD-PARTY COSTS
Applicable costs from airlines, cruise operators, tour operators, and merchant fees will be deducted.
DEDUCTIONS FOR INSPIRING VACATIONS' COSTS
Only actual costs (not fees) incurred by Inspiring Vacations will be deducted.
Inspiring Vacations does not seek to profit from Force Majeure events.
OPERATIONAL COSTS DEDUCTED
Costs related to the normal business operations of Inspiring Vacations, including:
Marketing
Management
Fulfillment
PROCESSING BY CUSTOMER SUCCESS TEAM
The Customer Success Team will handle the credit processing.
They will also manage all customer communication related to the credit.
