END USER LICENSE AGREEMENT (EULA) — Game Maps Reality IRL

This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “user”) and the developer of the Game Maps Reality IRL mobile application (“Licensor,” “we,” “us,” or “our”) regarding your use of the Game Maps Reality IRL iOS application and any related updates, features, and documentation (the “Licensed Application” or “App”).

By downloading, installing, or using the App, you agree to this EULA, our Terms of Use, and our Privacy Policy. If you do not agree, do not download or use the App.

1. ACKNOWLEDGEMENT

You acknowledge that this EULA is concluded between you and the Licensor only, and not with Apple Inc. (“Apple”). The Licensor, not Apple, is solely responsible for the Licensed Application and its content. This EULA must not conflict with the Apple Media Services Terms and Conditions or the App Store Terms of Service that you accept.

2. SCOPE OF LICENSE

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions / App Store Terms of Service.

This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time, except as expressly permitted by Apple’s rules (for example, Family Sharing where applicable).

You may not:

• Copy (except as permitted by this EULA and Usage Rules), reverse-engineer, disassemble, attempt to derive source code, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except where applicable law prohibits such restriction)

• Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application

• Remove proprietary notices

• Use the App to violate law, infringe rights, or interfere with the App’s security, entitlements, or payment systems

3. CONSENT TO USE OF DATA

You agree that the Licensor may collect and use technical data, location data (with your permission), diagnostics, and related information as described in the Privacy Policy, to provide navigation and map features, maintain and improve the App, process purchases, and provide support. 4. APPLE’S ROLE; MAINTENANCE AND SUPPORT

The Licensor is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as required under applicable law. You and the Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

5. WARRANTY

The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you, to the extent required by Apple’s policies and applicable law. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Licensor’s sole responsibility, subject to the disclaimers and limitations in the Terms of Use.

6. PRODUCT CLAIMS

You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit the Licensor’s liability beyond what is permitted by applicable law.

7. INTELLECTUAL PROPERTY

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, the Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by law.

Map themes in the App are game-inspired visual styles for entertainment and personal navigation. Unless expressly stated, they are not affiliated with, sponsored by, or endorsed by any third-party game publisher or trademark owner.

8. LEGAL COMPLIANCE

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to comply with applicable local laws regarding online conduct and acceptable content.

9. THIRD-PARTY TERMS / BENEFICIARY

You must comply with applicable third-party terms when using the App (for example, wireless data terms, map data provider terms, and Apple’s terms).

You and the Licensor acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

10. NAVIGATION AND SAFETY

The App provides consumer navigation and map visualization for convenience. It is not a substitute for safe driving, posted signs, traffic laws, or your judgment. You assume all risk arising from reliance on routes, place data, or map information. See the Terms of Use for the full safety disclaimer.

11. PURCHASES AND SUBSCRIPTIONS

Optional paid features (including subscriptions or one-time purchases such as “Game Maps Pro”) are offered through Apple In-App Purchase and are subject to Apple’s payment, renewal, and refund rules, as well as the Terms of Use.

12. TERMINATION

This EULA is effective until terminated by you or the Licensor. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Licensed Application and destroy all copies.

13. GOVERNING LAW; CONSUMER RIGHTS

To the extent permitted by law and subject to mandatory consumer protections in your country of residence, this EULA is governed by the laws applicable to the Licensor’s principal place of business, without regard to conflict-of-law rules. Nothing in this EULA limits non-waivable consumer rights.

These documents together with this EULA govern your use of the App. If there is a conflict between this EULA and Apple’s mandatory App Store license terms for the relevant territory, Apple’s mandatory terms control to the extent of the conflict.
