1. Acceptance of Terms

By downloading, installing, or using the FomNi mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our App.

2. Eligibility

You must be at least 18 years old to use this App. By using FomNi, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

3. Account Registration

• You must provide accurate, complete, and current registration information

• You are responsible for maintaining the confidentiality of your account credentials

• You agree to notify us immediately of any unauthorized use of your account

• We reserve the right to suspend or terminate accounts that provide false information

4. User Responsibilities

You agree not to:

• Use the App for any illegal or unauthorized purpose

• Post, share, or transmit content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

• Impersonate any person or entity

• Interfere with or disrupt the App's functionality

• Attempt to gain unauthorized access to other users' accounts or data

• Use automated systems or bots to access the App

5. Event Listings and Purchases

• Event information is provided by third-party organizers and we do not guarantee its accuracy

• All ticket purchases and event registrations are contracts between you and the event organizer

• We are not responsible for event cancellations, changes, or quality of events

• Refund policies are determined by individual event organizers

6. Payments

• No Payments are collected by FomNi as posting of Events is free

7. Intellectual Property

• The App, including its design, features, and content, is owned by Otioz Enterprices and protected by intellectual property laws

• You may not copy, modify, distribute, or create derivative works based on our App

• User-generated content remains your property, but you grant us a license to display and distribute it within the App

8. Privacy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

We may suspend or terminate your access to the App at our sole discretion if you violate these Terms. You may also terminate your account at any time by following our account deletion process.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OTIOZ ENTERPRICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Indemnification

You agree to indemnify and hold harmless OTIOZ ENTERPRICES, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
