By downloading, installing, or using Fire Fling ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Fire Fling.

ELIGIBILITY
You must be at least 18 years old to use Fire Fling. By using the App, you confirm that you are 18 years of age or older. We reserve the right to terminate accounts of users found to be under 18 and delete all associated data immediately. Age verification may be requested at any time.

ACCOUNT REGISTRATION
To use Fire Fling, you must create an account using a valid email address or supported social login (Apple or Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as needed.

SAFETY RULES
Fire Fling is designed for spontaneous in-person connections in public places. By using the App, you agree to the following safety rules:
Only use Fire Fling in public places such as cafes, parks, malls, or events. Never arrange to meet other users at private residences, isolated locations, or anywhere you feel unsafe.
Tell a friend or family member where you are going and who you are meeting before any in-person meeting.
Trust your instincts. If something feels wrong, leave immediately and block the user.
Never share personal information such as your home address, workplace address, or financial information with other users.
You are solely responsible for your own safety when meeting other users in person. Fire Fling is not responsible for any harm resulting from in-person meetings arranged through the App.
Immediately block and report any user whose behavior makes you uncomfortable or who violates these Terms.

COMMUNITY GUIDELINES
By using Fire Fling, you agree not to:
Create false or misleading profile information or upload photos of anyone other than yourself
Harass, stalk, threaten, intimidate, or harm other users
Use the App for any illegal purpose including solicitation, trafficking, or fraud
Solicit money, financial information, or gifts from other users
Send unsolicited commercial messages or spam
Impersonate another person or entity
Use automated bots or scripts to interact with the App
Attempt to access other users' accounts or private data
Upload content that is obscene, offensive, or violates any law
Circumvent or attempt to circumvent any security features of the App

REPORTING AND ENFORCEMENT
Fire Fling takes community safety seriously. Our enforcement policy is as follows:
Users may report other users for inappropriate behavior directly from the map screen
Reports are reviewed and tracked on a rolling 24-hour basis
1 to 2 reports within 24 hours: Warning notification sent to the reported user
3 or more reports within 24 hours: Account suspended for 3 days
Second suspension: Account suspended for 7 days
Third offense: Permanent account ban with no right of appeal
We reserve the right to suspend or terminate any account at any time for any violation of these Terms without notice or refund

SUBSCRIPTION AND BILLING
Fire Fling operates on the following pricing model:
Free Trial: 7 days of full access with no restrictions and no payment required
Monthly Subscription: $25.00 per month after the free trial period
Subscriptions are managed and billed through Apple App Store or Google Play depending on your device
Payment is charged to your App Store or Google Play account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
You may cancel your subscription at any time through your App Store or Google Play account settings
No refunds are provided for partial subscription periods or unused time
Prices are subject to change with reasonable notice to users

EU CONSUMER RIGHTS
If you are located in the European Union, the following additional terms apply in accordance with EU consumer protection law:
You have the right to withdraw from any purchase within 14 days without giving any reason, unless the digital service has already begun with your explicit consent and acknowledgment that you lose your right of withdrawal once the service begins
Subscription cancellations by EU users will be processed in accordance with applicable EU consumer protection regulations
Fire Fling complies with the EU Digital Services Act and applicable EU consumer rights directives
Any disputes with EU users may be submitted to your local consumer protection authority or via the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr

GDPR AND DATA PROTECTION FOR EU USERS
If you are located in the European Union, the following terms apply under the General Data Protection Regulation (GDPR):
Our legal basis for processing your personal data is your explicit consent given at first launch of the App
You have the right to access, correct, delete, restrict, and port your personal data at any time
You have the right to withdraw consent at any time by deleting your account through Settings > Delete My Account
You have the right to lodge a complaint with your local data protection authority
We will notify you of any data breach affecting your personal data within 72 hours of becoming aware of it
We do not use your data for automated decision-making or profiling beyond the matching functionality described in our Privacy Policy
We do not transfer your personal data outside the European Economic Area without appropriate safeguards in place

INTELLECTUAL PROPERTY
Fire Fling and all its content, features, and functionality including but not limited to the name, logo, design, text, graphics, and software are owned by Fire Fling and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

USER CONTENT
You retain ownership of any content you submit to Fire Fling including your profile photo. By submitting content, you grant Fire Fling a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating the App. You represent that you own or have the right to submit any content you provide.

DISCLAIMER OF WARRANTIES
Fire Fling is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not guarantee the accuracy of any user-provided information including profile photos. We make no guarantees about the safety of in-person meetings arranged through the App.

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Fire Fling and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to personal injury, property damage, loss of data, or harm resulting from in-person meetings arranged through the App. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

INDEMNIFICATION
You agree to indemnify and hold harmless Fire Fling and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another user.

GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the State of Nebraska, United States, without regard to its conflict of law provisions. EU users retain the protection of mandatory consumer protection laws in their country of residence. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the state or federal courts located in Nebraska, except where prohibited by applicable EU law.

CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. We will notify users of material changes through an in-app notification or email at least 30 days before the changes take effect. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

TERMINATION
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately and your data will be deleted within 30 days in accordance with our Privacy Policy.
