Terms of Use

These Terms of Use ("Terms") govern your use of the Familydeck mobile application ("the App"), developed by Yassine Hammouti ("we", "our", "us").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.
2. Description of Service
Familydeck is a conversation card game designed for families. The App provides themed question decks to facilitate meaningful conversations and bonding moments.
3. Subscriptions and In-App Purchases
Familydeck offers the following purchase options:
a) Weekly Subscription
• Provides full access to all decks and questions.
• Includes a 3-day free trial for eligible new subscribers.
• Price: displayed at the time of purchase in your local currency.
• Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial period if not canceled.
• Subscription automatically renews each week unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription.
b) Lifetime Purchase
• A one-time payment that grants permanent access to all decks and questions.
• This is a non-consumable purchase. It does not expire and does not auto-renew.
c) Managing Subscriptions
• You can manage or cancel your subscription at any time through your Apple ID Settings: Open Settings > tap your name > Subscriptions > Familydeck.
• Cancellation takes effect at the end of the current billing period. You will retain access until that date.
• Deleting the App does not cancel your subscription.
d) Restoring Purchases
• You can restore previous purchases at any time via Settings > Restore Purchases within the App.
e) Refunds
• All purchases are processed by Apple. To request a refund, visit https://reportaproblem.apple.com or contact Apple Support.
• We do not process payments or refunds directly.
4. Free Trial
• Eligible new subscribers may receive a free trial as displayed at the time of subscribing.
• You will not be charged during the free trial period.
• If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged.
• Free trial eligibility is determined by Apple and is limited to one free trial per Apple ID.
5. Intellectual Property
All content in the App, including but not limited to questions, text, illustrations, icons, designs, layouts, and source code, is the exclusive property of Yassine Hammouti and is protected by applicable copyright and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the App without prior written permission.
6. User Conduct
You agree to:
• Use the App only for its intended purpose as a family card game.
• Comply with all applicable laws and regulations.
You agree not to:
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Copy, modify, or create derivative works of the App or its content.
• Distribute, sell, lease, sublicense, or transfer the App to any third party.
• Use the App for any unlawful, harmful, or fraudulent purpose.
• Attempt to circumvent any security or access control mechanisms.
7. Availability
We strive to keep the App available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any feature of the App at any time without prior notice.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be error-free, uninterrupted, secure, or free of viruses or other harmful components.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YASSINE HAMMOUTI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Termination
We reserve the right to terminate or suspend your access to the App at our sole discretion, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your license to use the App is immediately revoked. Sections 5, 8, 9, and 11 survive termination.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
13. Apple's Role
You acknowledge that these Terms are between you and Yassine Hammouti, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.
