Terms of Use – SwapMagic: AI Face Swap
These Terms of Use ("Terms") govern your use of the mobile application SwapMagic: AI Face Swap ("app"), made available by Toolnova ("we," "us," or "our"). By downloading, installing, opening, or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. Eligibility
SwapMagic: AI Face Swap is intended for users who are 18 years of age or older. By using the app, you represent that you are at least 18 and have the legal capacity to enter into this agreement. The app is not intended for users in jurisdictions where use would be prohibited by law.
2. Description of the service
SwapMagic: AI Face Swap provides AI-powered face swap for photos and videos. You can:
- Use templates and categories to create face swap images.
- Upload your own photos to create custom face swaps.
- Swap your face into video templates or use your own video clips (trim, pick a face, and generate).
- Save approved face photos inside the app and reuse them across swaps.
- Save and manage your creations in the in-app gallery ("My Creations").
- Subscribe or purchase credits and credit top-up packs for additional features and usage.
The app requires an internet connection for AI processing. We may change, suspend, or discontinue features or the app itself with reasonable notice where feasible, subject to applicable law.
3. Content standards and moderation
We expect all use of SwapMagic to stay respectful, lawful, and appropriate for a general audience. To support that:
- Photos and videos you submit may be screened by automated systems for nudity, sexually explicit material, and other disallowed content before they are processed or uploaded.
- Content that fails these checks is blocked in the app and is not sent for AI processing.
- You must not upload, create, or attempt to generate sexual, harassing, hateful, violent, or otherwise harmful material.
- Automated screening is not perfect; we may make mistakes. If you believe a decision is wrong, contact us at support@toolnova.com.
- We may refuse to process content, remove creations, or suspend or terminate access if you violate these standards or try to bypass moderation.
- The app includes an in-app reporting tool so you can flag templates, categories, results, or creations that you believe violate these rules.
These rules help us comply with Google Play policies and keep the service safe for everyone.
4. Your responsibilities and acceptable use
You agree to use the app only for lawful purposes and in line with these Terms. You are responsible for your conduct and for any content (including photos and videos) you upload or create.
You agree to:
- Use only media you have the right to use (e.g. your own face, or clear consent from anyone whose face or likeness appears).
- Upload only appropriate, fully clothed, non-explicit images and videos suitable for a public setting.
- Not use the app to harass, defame, impersonate, or harm others, or to create content that is illegal or infringes others' rights.
- Not reverse-engineer, copy, or misuse the app, its content, or our systems.
- Not use automated means (bots, scripts) to access or use the app unless we explicitly allow it.
- Comply with all applicable laws and with Google Play's terms and policies where you downloaded the app.
5. Prohibited use
You must not use the app to:
- Upload, create, or share nude, sexually explicit, pornographic, or sexually suggestive content, including attempts to swap faces onto such material.
- Create or share content involving minors, or any sexual or suggestive content involving anyone under 18.
- Create or share content that is illegal, harmful, threatening, abusive, defamatory, or that invades privacy or infringes intellectual property or other rights.
- Use another person's face, image, or likeness without their clear consent, or to impersonate anyone.
- Create deepfakes or misleading AI output presented as genuine photos or videos of real events or people.
- Distribute spam, malware, or anything that could harm the app, our systems, or other users.
- Circumvent or attempt to circumvent content moderation, access controls, usage limits, or payment systems.
- Resell, sublicense, or commercially exploit the app or our content (e.g. templates) in a way not permitted by us.
We may suspend or terminate your access and report illegal activity to authorities if we believe you have violated these Terms or the law.
6. User content and your creations
"User content" means photos and videos you upload and any images or videos you create in the app (e.g. face swaps).
You keep ownership of your user content. By using the app, you grant us a limited license to use, store, process, and display your user content only as needed to provide the service (e.g. to run face swap processing, show your creations in My Creations, and operate the app). We do not claim ownership of your photos, videos, or creations.
You are responsible for ensuring you have the right to use and grant this license for all user content. We may remove or refuse to process content that we believe violates these Terms or the law. We do not guarantee that AI-generated results will meet your expectations; quality depends on input media and our systems.
Because the app uses generative AI, results may not be unique, and similar results may be generated for other users. You are responsible for how you use and share your creations.
7. Intellectual property
The app, including its name "SwapMagic: AI Face Swap," design, code, templates, and other materials we provide (other than your user content), are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the app or our content except as allowed in these Terms or with our written permission. You may use the app only for personal, non-commercial use in line with these Terms.
8. Subscriptions and in-app purchases
The app may offer subscriptions and one-time purchases (e.g. credit packs and top-up packs) through Google Play. Payment, billing, and refunds are handled by Google Play under Google's terms and policies. We do not process payments directly and cannot issue refunds; any refund request must be made through Google Play (e.g. via your Google Play account or support).
Subscription terms (e.g. price, renewal, cancellation) are shown in the app and in the Google Play listing before you purchase. Subscriptions typically renew automatically until you cancel. You can manage or cancel subscriptions in your Google Play account settings. Unused credits or subscription benefits generally do not carry a cash value and may expire as described in the app or at the end of a subscription period.
Some actions may let you watch a rewarded ad to earn credits or unlock a benefit (such as removing a watermark). This happens only when you choose that action in the app.
Non-Premium users may see watermarks on downloaded or shared outputs. Premium subscribers may receive outputs without certain watermarks or ads, as described in the app.
9. Disclaimers
The app and all content and features are provided "as is" and "as available." We do not warrant that the app will be uninterrupted, error-free, or that results (including AI-generated images and videos) will be accurate or suitable for any purpose. AI output may vary and can be imperfect; we are not liable for how you or others use created content. Face swap and AI video results can be misleading if shared without disclosure.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimer limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by applicable law:
- We (and our affiliates, directors, employees, and agents) are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use or inability to use the app, any user content, or these Terms.
- Our total liability for any claims arising from or related to the app or these Terms shall not exceed the amount you paid us in the twelve (12) months before the claim (or, if you have paid nothing, fifty US dollars (USD 50) or the equivalent in your local currency).
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for certain types of damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Toolnova and its affiliates, directors, employees, and agents from and against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the app; (b) your user content or your violation of these Terms; or (c) your violation of any law or the rights of a third party.
12. Termination
You may stop using the app at any time and uninstall it. If you have a subscription, you must cancel it through your Google Play account to avoid further charges.
We may suspend or terminate your access to the app, or discontinue the app or any feature, at any time with or without notice, for any reason, including if we believe you have violated these Terms or for operational or legal reasons. Upon termination, your right to use the app ceases. Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive termination.
13. Changes to these terms
We may update these Terms from time to time. We will indicate changes by updating the "Last updated" date at the end of this document. Continued use of the app after changes take effect means you accept the updated Terms. If you do not agree, you must stop using the app. For material changes, we may notify you in the app or by other reasonable means where required by law.
14. General
Entire agreement. These Terms, together with our Privacy Policy and any in-app terms or notices we show you, constitute the entire agreement between you and us regarding the app and supersede any prior agreements or understandings.
Severability. If any part of these Terms is held invalid or unenforceable, the remaining parts will remain in effect.
No waiver. Our failure to enforce any right or provision of these Terms does not waive that right or provision.
Governing law and disputes. These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising from or related to the app or these Terms shall be subject to the exclusive jurisdiction of the courts of India. If you are in another country, local mandatory laws may apply to you.
Google Play. Your use of the app may also be subject to Google Play's terms and policies. In the event of a conflict between those and these Terms regarding your use of the app, these Terms will apply to the extent of the conflict, except where Google Play terms are mandatory.
