Definitions

The terms ‘you’ and ‘User’ refer to any third party that accesses, uses or views the Website and is not
employed by us and acting in the course of their employment; or
engaged as a consultant or otherwise providing services to us and accessing the Website in connection with the provision of such services.
'Cookies' are small blocks of data placed on your computer when you browse the Website and/or when you use certain features of the Website.
'Data' is the information that you submit to us via the Website and it incorporates, where applicable, the definitions provided in the Privacy Law.
The 'Cookie Law' is the Privacy and Electronic Communications (EC Directive) Regulations 2003, including any modification or amendment made to it.
'Invoice' means the invoice for the Services. It sets out the fees at the time we accept the request for Services.
The 'Privacy Law' is
the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of Council of 27 April 2016, abbreviated as GDPR, including any modification or amendment made to of; together with
the Data Protection Act 2018 of the United Kingdom of Great Britain and Northern Ireland, including any modification or amendment made to it.
The ‘Services’ are the services advertised on the Website. They are supplied from us to you with the description, price and in the number set out in the Invoice.
The 'Session' is a video-call meeting intended to provide the Services outlined in the Invoice.
The ‘Website’ is the website you are currently using (https://sites.google.com/view/ev-mentoring) and any sub-domains of this site, unless expressly excluded by their own terms and conditions.
In the Privacy Policy, unless the context requires a different interpretation:
the singular includes the plural and vice versa;
references to sub-clauses, clauses, schedules or appendices are to those within the Privacy Policy;
a reference to a person includes individuals, firms, companies, government entities, trusts and partnerships;
"including" is understood to mean "including without limitation";
reference to any statutory provision includes any modification or amendment made to it;
the headings and sub-headings do not form part of the Privacy Policy.
Application
This document sets forth the Privacy Policy governing the relationship between you and us. The Privacy Policy is is incorporated into the Terms and Conditions and it applies to our use of any and all Data collected by us or provided by you in connection to the use of the Website.
By accessing or using the Website, you agree to the collection, use and disclosure of your information in accordance to the Privacy Policy. You must not use the Website if you do agree to the Privacy Policy.
We have not appointed a Data Protection Officer, as we do not fall within the categories of controllers and processors required to appoint one under Article 37 of the GDPR.
Updates
We reserve the right to change the Privacy Policy at any time. When we do so, we will update the date at the bottom of this page. Changes will take effect immediately upon their posting on the Website. Your continued use of the Website is deemed to be accepting of such changes.
Collection of Data
We collect and process your Data in compliance with the Privacy Law.
We may collect the following Data, which includes personal data, from you:

contact information, such as the email addresses;
other information submitted in the Contact Form in the Website;
demographic information, such as preferences and interests;
payment information, such as bank accounts and billing addresses;

documents that you provide for us to supply a Service, such as a curriculum vitae submitted for review;
comments, feedback and survey responses.
Data collection may be automatic or through voluntary actions, for example when you submit the Contact Form on the Website, send us documents or provide feedback.
We may use automatic data collection technologies, such as Google Analytics, to collect information about your activity on the Website. The automatically-collected information does not include personal information.
The Website is not intended for use by Users under 18 years of age. We do not knowingly collect or process personal data from Users under 18 years of age. If we become aware that such Data has been inadvertently collected, it will be deleted promptly.

Retention of Data
We retain any information you provide to us until the earliest of the following:
you request that the information is deleted;
for as long as it is necessary, which is usually the duration of the relationship between you and us and up to a period of 7 years after its conclusion;
our decision that the cost of retaining the Data outweighs its value.
We may however be required to retain personal data for a longer period of time to ensure we comply with our legislative and regulatory requirements. We review our obligations to ensure we do not retain Data for longer than is permitted by law.
Disclosures
As a general rule, we do not sell, rent, lease, transfer or disclose your Data to third parties, unless under the following circumstances:
when we are compelled to do so by law, in other words, when we believe in good faith that the such disclosure is necessary to comply with legal obligations or protect our legal rights, or when required by a court or governmental entity;
when we permitted to do so for any legal proceeding, such as enforcing the Terms and Conditions or any other agreement between you and us;
when third-party disclosures are specifically set out in the Privacy Policy.
Third-party websites
We may engage third-party service providers to assist with certain operations of the Website and provision of the Services. The providers may have access to certain personal data provided by Users of the Website in order to perform the requested services.
Any Data shared with such parties is limited to what is necessary to perform their functions. Any use for other purposes is prohibited. Third-party processing will be conducted within the terms of the Privacy Policy and in compliance with the Privacy Law.
The Website may contain links to other websites. We have no control over such websites and are not responsible for their content. The Privacy Policy does not extend to your use of such websites.
Data storage and security
All personal data is stored securely in accordance with the principles of the Privacy Law.
We implement reasonable physical and electronic measures to safeguard and secure your personal information from unauthorised access or disclosure.
The Website is hosted on the Google Sites platform. Your Data may be stored on the Google Drive storage service. Google stores your Data on secure servers behind a firewall.
Transmission of information over the internet or email communication are not entirely secure and are carried out at your own risk. We cannot guarantee the security of your Data transmitted to the Website beyond what is reasonably practical.
We may transfer your collected Data to storage outside the European Economic Area (EEA) or the UK, including for facilitating the Services and payments. When such transfers occur, we will take reasonable steps to ensure that your Data is treated as safely and securely as it would be within the EEA or the UK and under the Privacy Law. These steps may include, but not be limited to, the use of legally-binding clauses between us and any third parties we engage with and the use of the EU-approved Model Contractual Arrangements. If any provision, or part of provision, of the Terms and Conditions is found to be invalid, illegal or unenforceable by a court or other competent authority, that part shall be severed to the extent necessary and the remaining provisions shall remain in full force and effect.
Unless otherwise agreed in writing, no delay, omission or failure by either party to exercise any right or remedy shall be deemed a waiver of that or any other right or remedy.
The Privacy Policy shall be governed by and interpreted according to the law of England and Wales. Any disputes, including non-contractual disputes or claims, shall be subject to the exclusive jurisdiction of the English and Welsh courts.
