These Terms of Use (“Terms”) govern your access to and use of the English Target: Learn & Speak mobile application (“English Target” or the “App”), provided by NOVATECH SOFT (“we,” “our,” or “us”).
Please read these Terms carefully. By downloading, installing, accessing, or using English Target, you agree to these Terms. If you do not agree, do not use the App.
1. ABOUT ENGLISH TARGET
English Target is an educational mobile application designed to help users practice English through grammar rules, basic sentences, question making, speaking exercises, tests, daily challenges, progress tracking, and achievements.
The App is provided as a learning and practice tool. It does not provide formal academic certification, professional language accreditation, or a guarantee of fluency, examination success, employment, or any specific learning outcome.
2. ELIGIBILITY
You may use English Target only if you are legally permitted to use mobile applications under the laws applicable to you.
If you are under the age at which you can independently accept these Terms, you may use the App only with the permission and supervision of a parent or legal guardian.
Parents and guardians are responsible for supervising a minor’s use of the App and reviewing any permissions enabled on the minor’s device.
3. ACCEPTABLE USE
You agree to use English Target only for lawful, personal, and educational purposes.
You must not:
• Use the App for illegal, harmful, fraudulent, or abusive activities
• Attempt to interfere with or damage the App’s operation
• Introduce malware, harmful code, or automated attacks
• Attempt to gain unauthorized access to any App component or related service
• Reverse engineer, decompile, modify, redistribute, resell, or create unauthorized copies of the App, except where applicable law expressly permits it
• Remove or alter copyright, trademark, branding, or ownership notices
• Use the App or its content to violate another person’s intellectual-property, privacy, or legal rights
• Misrepresent yourself as being affiliated with NOVATECH SOFT
• Use automated systems to extract, reproduce, or republish substantial parts of the App’s content without written permission
4. LICENSE TO USE THE APP
Subject to these Terms, NOVATECH SOFT grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use English Target on a compatible device for personal educational purposes.
This licence does not transfer ownership of the App, its design, source code, learning content, branding, graphics, or other intellectual property.
5. EDUCATIONAL CONTENT
We aim to provide useful and accurate English-learning materials. However, language usage may vary according to context, region, dialect, formality, and accepted teaching methods.
The App’s lessons, translations, examples, pronunciation guidance, test results, and suggestions are provided for general educational purposes.
You remain responsible for verifying information where accuracy is important. English Target should not be treated as a replacement for a qualified teacher, official textbook, professional translator, or accredited examination provider.
6. SPEAKING AND SPEECH-RECOGNITION FEATURES
The App may offer optional speaking and pronunciation activities that use your device’s microphone and speech-recognition service.
Speech-recognition results may be affected by:
• Pronunciation and accent
• Background noise
• Microphone quality
• Device settings
• Internet availability
• Language configuration
• Limitations of the selected speech-recognition provider
We do not guarantee that every spoken word will be recognised or evaluated accurately.
You may deny or revoke microphone permission. However, speaking-related features may not function without microphone access.
7. TEXT-TO-SPEECH AND AUDIO
English Target may use a text-to-speech engine installed or selected on your device to read learning content aloud.
The availability, voice, pronunciation, quality, language support, and operation of text-to-speech are controlled partly by your device and selected provider. We are not responsible for interruptions or inaccuracies caused by an external text-to-speech service.
8. LEARNING PROGRESS
The App may store learning progress, XP, levels, streaks, achievements, test results, completed lessons, and preferences locally on your device.
Local information may be lost if you:
• Uninstall the App
• Clear the App’s storage or data
• Reset or replace your device
• Use device-cleaning software
• Experience device or storage failure
Unless a future version clearly provides cloud synchronisation, NOVATECH SOFT does not guarantee backup, recovery, synchronisation, or transfer of local learning progress between devices.
XP, levels, badges, streaks, and achievements are virtual learning indicators. They have no monetary value and cannot be exchanged for cash, products, or services.
9. SAVING AND SHARING PROGRESS CARDS
English Target may allow you to generate, save, and share progress or achievement cards.
When you save a card, it may be stored in your device’s gallery. When you share a card, the device’s standard sharing interface allows you to select an external app or service.
You are responsible for:
• Selecting an appropriate sharing destination
• Reviewing the content before sharing
• Respecting the privacy and rights of others
• Complying with the rules of the selected social-media or messaging service
NOVATECH SOFT does not control third-party platforms and is not responsible for how they process, display, retain, or distribute content that you choose to share.
10. PRIVACY
Your use of English Target is also governed by our Privacy Policy, which explains the App’s permissions and information-handling practices.
The Privacy Policy forms part of these Terms. You should review it before using microphone, gallery, sharing, support, or other relevant features.
11. INTELLECTUAL PROPERTY
English Target and its original components—including its name, logo, interface, design, text, lesson organisation, graphics, software, and branding—are owned by or licensed to NOVATECH SOFT and are protected by applicable intellectual-property laws.
Third-party software, fonts, icons, services, and libraries remain the property of their respective owners and may be governed by separate licences.
Nothing in these Terms gives you permission to use the English Target or NOVATECH SOFT name, logo, branding, or content for commercial purposes without prior written permission.
12. THIRD-PARTY SERVICES
The App may rely on or interact with third-party services, including:
• Android operating-system services
• Speech-recognition providers
• Text-to-speech providers
• Gallery and media-storage services
• Email applications
• Applications selected through the system sharing interface
• Google Play and related device services
We do not own or control these services. Their operation is governed by their respective terms and privacy policies.
NOVATECH SOFT is not responsible for third-party service availability, content, data handling, security, changes, suspension, or errors.
13. APP UPDATES AND COMPATIBILITY
We may release updates to improve features, security, compatibility, content, or policy compliance.
Some updates may change, add, or remove features. Continued use of the App may require an updated version of Android, device permissions, third-party services, or sufficient storage.
We do not guarantee that the App will remain compatible with every device, operating-system version, manufacturer configuration, speech engine, or accessibility setting.
14. APP AVAILABILITY
We aim to keep English Target available and functional, but we do not guarantee uninterrupted or error-free access.
The App or any feature may be modified, suspended, restricted, or discontinued for maintenance, security, technical, legal, business, or policy reasons.
Where reasonably possible, important changes may be communicated through the App, Google Play listing, or this legal website.
15. USER SUPPORT
You may contact us regarding technical problems, policy questions, or other support matters.
When requesting support, provide only information reasonably necessary to explain the issue. Do not send passwords, financial details, government identification numbers, or unnecessary sensitive information.
Support availability and response times are not guaranteed, but we will make reasonable efforts to review legitimate requests.
16. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, English Target is provided on an “as is” and “as available” basis.
NOVATECH SOFT does not guarantee that:
• The App will always be available, uninterrupted, secure, or error-free
• Every lesson, translation, pronunciation, or answer will be completely accurate in every context
• Speech recognition will correctly understand every user
• Learning progress will never be lost
• The App will meet every user’s individual learning requirements
• Use of the App will produce a specific educational or professional result
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, NOVATECH SOFT will not be liable for indirect, incidental, special, consequential, or punitive loss arising from or connected with:
• Use of or inability to use the App
• Loss of local learning progress
• Device failure or storage loss
• Speech-recognition or text-to-speech errors
• Reliance on educational content
• User-initiated sharing
• Third-party applications or services
• Unauthorized use of a user’s device
This limitation does not apply where liability cannot legally be excluded or limited.
18. RESPONSIBILITY FOR VIOLATIONS
You are responsible for your use of the App and for violations of these Terms caused by your actions.
Where permitted by law, you agree to be responsible for reasonable losses or claims resulting from your unlawful use of the App, infringement of another person’s rights, or deliberate violation of these Terms.
19. SUSPENSION OR TERMINATION
You may stop using English Target at any time by uninstalling the App.
We may restrict or discontinue access to the App or particular features where reasonably necessary to:
• Protect users or the App
• Address security or technical risks
• Comply with legal or Google Play requirements
• Prevent misuse or infringement
• Discontinue the App or a feature
Provisions concerning intellectual property, disclaimers, liability, and applicable law will continue where legally appropriate after use ends.
20. GOVERNING LAW
These Terms are governed by the applicable laws of Bangladesh, without limiting any mandatory consumer rights that apply in the country where you live.
Any dispute should first be submitted to us through the contact email below so that both parties can attempt to resolve it informally and in good faith.
21. CHANGES TO THESE TERMS
We may update these Terms when the App, its features, legal requirements, or business practices change.
Updated Terms will be published on this page with a revised “Last updated” date. Continued use of the App after an update constitutes acknowledgement of the revised Terms to the extent permitted by law.
