TERMS & CONDITIONS FOR REGISTRATION OF EC COURSES
I, the parent / guardian (the “Parent”) of the student (the “Student”), hereby agree to the following terms and conditions (the “General Terms”).
Interpretation
In these Terms & Conditions, the following words and phrases shall bear the following meanings, unless the context requires otherwise:
“Academic Year” means an academic year at EMBER'S CHAMBER, which runs from 30 November 2023 to 30 November 2024
“Calendar Month” means a full month commencing on the 1st day of a calendar month and ending on the last day of that calendar month; and
“Ember's Chamber”, means the entity which runs English and Science Primary Tuition and Educational blog;
"Student" means children under the age of 13 and in Primary School. All Student(s) will require parental consent;
"Billing Cycle" means course fee(s) billed once every month (may be 4 or 5 lessons);
2. These Terms & Conditions apply to the provision of all Services by EMBER'S CHAMBER to the Student upon the engagement of the Client, and are to be complied with by the Client, Parents and Student at all times and are deemed incorporated in the engagement of EMBER'S CHAMBER and the provision of the Services. EMBER'S CHAMBER may revise these Terms & Conditions and the Client, Parent and Student shall continue to be subject to such Terms & Conditions as amended, modified and/or substituted by EMBER'S CHAMBER from time to time and published on EMBER’S CHAMBER's website at https://sites.google.com/view/emberschamber/terms-conditions. The utilisation and continued utilisation (upon an amendment, modification and/or substitution of the Terms & Conditions) of the Services by the Student shall be deemed acceptance of these Terms and Conditions by the Client, Parents and Student whether or not the Terms & Conditions (and any subsequent amendment, modification and/or substitution) are signed and returned to EMBER'S CHAMBER by the Client.
3. The headings in these Terms & Conditions are for convenience only and shall not affect the interpretation hereof.
Conditions of Registration & Enrolment
4. The Client and Parents agree to fully disclose all information relevant to the Student’s enrolment and continued enrolment in EMBER'S CHAMBER. In the event that EC subsequently becomes aware that information considered reasonable for consideration for enrolment to EC has been withheld, falsified or is inaccurate, EMBER'S CHAMBER has the right to suspend or terminate the Student from any or all classes.
5. The enrolment / continue enrolment of the Student in the course(s) indicated on the Registration / Renewal Form (the “Registered Course(s)”) shall be conditional upon, inter alia:
payment of a deposit equivalent to 4 weeks of course fees for the Registered Course(s) (the “Deposit”), upon the registration / renewal of the Student’s enrolment in the Registered Course(s). For the avoidance of doubt, and subject to these General Terms, the Deposit shall be used to pay for any outstanding amounts owed to the Company, which shall include but is not limited to the course fees for the final 4 weeks of the Registered Course(s);
payment of materials fee for the Academic Year. For avoidance of doubt, and subject to these General Terms, the materials fee is not pro-rated regardless of the sign up date;
advance payment of the materials fee and course fee(s) of all Registered Course(s) before the first day of Billing Cycle.
6. EMBER'S CHAMBER reserves the right to suspend and/or terminate the Student with immediate effect from or to any or all classes in the event that the Client, Parents and/or Student breaches any provisions of the Contract, or EMBER'S CHAMBER deems, in its sole discretion, that the Client, Parents and/or Student demonstrates behaviour that is detrimental to the welfare or safety of the Staff or other parents and students of EMBER'S CHAMBER, or prejudicial to good order or the reputation of EMBER'S CHAMBER, or for any other reason that EMBER'S CHAMBER deems fit and proper in its absolute discretion. In the event that the Student is terminated from EMBER'S CHAMBER pursuant to this clause, EMBER'S CHAMBER will not be under any obligation to return any deposit or fees paid to EMBER'S CHAMBER. Without prejudice to the generality of this clause, examples of when EMBER'S CHAMBER may exercise its right include (but is not limited to) cases where the Client, Parents and/or Student:
a. cause or threaten to cause physical injury to other parents, students and/or Staff for any reason;
b. use threatening, abusive or insulting words or behaviour towards other parents, students and/or Staff;
c. harass, cause alarm or distress to other parents, students and/or Staff;
d. fail to comply with any policy, guidelines, code of conduct, regulation, notice, direction or instruction given by EC or any Staff in relation to the conduct of classes or the use of EC’s premises or items or any matter relating to the provision of the Services;
e. persistently behave in a manner that is disruptive and prevents the continuation of classes or the provision of the Services;
f. use, disclose or disseminate any of EC’s trademarks or copyright material without obtaining EC’s prior written consent; or
g. do not pay any fees payable to EC and which are outstanding and remain unpaid as at the first week of commencement of the Term. Should any investigations be deemed by EC (in its sole discretion) to be necessary or appropriate, the Student may be suspended or terminated from any or all classes pending such investigation.
7. Notwithstanding anything in these General Terms, the Student is not entitled to receive any materials for any classes which he or she has not paid for. In the event that the Student is registered for any of the Registered Course(s) after an Academic Year has begun, the Student shall be entitled to receive worksheets only from the date on which he or she begins attending the Registered Course(s).
8. Classes will not be held on the eve of Chinese New Year and any other public holidays which may be gazetted by the Government of Singapore from time to time. No replacement classes will be scheduled, and no refund of course fees will be given in lieu of any classes which would otherwise have been held on the aforementioned days.
9. EMBER'S CHAMBER shall not be obliged to refund any part of the course fees in the event that the Student fails to attend any class in the Registered Course(s) for any reason whatsoever. Subject to these General Terms, and in the event that the Student does not turn up for classes and the fees for that Billing Cycle remain unpaid, the Deposit shall be used to settle the unpaid fees.
Replacement Classes
10. EC does not provide replacement classes if a student misses a session due to illness, holiday plans, school activities, etc. Monthly fees will still be payable to keep a place at EC. Learning materials or resources will be provided to ensure continuity of learning. There will be no make-up classes or refund of fees if EMBER'S CHAMBER closes or there is a closure of classes due to an outbreak of contagious diseases (e.g. SARS) or other unforeseen circumstances beyond our control.
11. Replacement classes may be provided under the following circumstances:
Class Cancellation: If a scheduled class is canceled by EC due to unforeseen circumstances, a replacement class will be arranged.
Public Holiday Impact: If a class is affected by a public holiday and a significant number of students are unable to attend, efforts will be made to schedule a replacement class.
Teacher Absence: In the event of a teacher's absence, a replacement class may be scheduled depending on the availability of substitute teachers.
12. In the event that a replacement class cannot be scheduled, the course fees for the relevant Registered Course shall not be refunded or pro-rated. Learning materials or resources will be provided to ensure continuity of learning.
13. In the event that a student is unable to attend the replacement class, no further arrangements will be made even if the Student has valid reason(s) for missing the replacement class. Learning materials or resources will be provided to ensure continuity of learning.
14. Replacement classes are non-transferable and cannot be exchanged for monetary compensation or other services.
Conduct of classes
15. EMBER'S CHAMBER reserves the right to, if it deems fit in its sole discretion,
(a) combine or dissolve a class,
(b) make changes to any of the classes,
(c) refuse entry to the Student if the Student is deemed to be unwell and
(d) amend or vary timings, availability, venues, content and specialist trainers according to programme priorities and student needs.
EMBER'S CHAMBER will inform the Client, Parent and/or Student of any of the above changes.
16. EMBER'S CHAMBER does not guarantee that a Student will be able to attend any particular class or timeslot or to receive classes from any particular Staff. EMBER'S CHAMBER reserves the right to place a Student in an appropriate class or timeslot (in its absolute discretion) depending on the availability of classes, the class capacity, available Staff and/or EMBER'S CHAMBER’s assessment (in its absolute discretion) of the suitability of the Student in ability, conduct, temperament or any other particular reason for any particular class.
17. The Student shall not be entitled to receive any materials for any classes which he or she has not registered and paid for. In the event that the Student commences classes mid-way during any programme or Term, the Student shall be entitled to receive materials used in that class only from the date on which the Student begins attending the classes.
18. Fees for unattended lessons are strictly not refundable.
19. There will be no classes held on
(i) public holidays (whether general, gazetted or otherwise declared or observed in Singapore),
(ii) if a public holiday falls on a Sunday, the day next following (not being itself a public holiday), or
(iii) such other days as designated by EMBER'S CHAMBER as a non-schooling day for any reason (including without limitation weather/emergency/safety reasons, for the purposes of school retreats/excursions or other administrative nonworking days etc.). Unless otherwise indicated, no replacement classes will be scheduled and no refund of class fees will be given in lieu of any classes which would otherwise have been held but for the same.
Withdrawals & Refunds
A notice of withdrawal must be given at least one Calendar Month before the Student’s withdrawal from any of the Registered Course(s), and the Deposit shall be used to offset the course fees due for the relevant notice period or the last 4 lessons’ tuition fees. In the event that less than one Calendar Month notice is given, no part of the Deposit will be refunded.
In the event that the accrued amount of the last 4 lessons' tuition fees are not enough to offset the Deposit, the remaining amount shall be used to offset lessons' charges till exhausted.
Unless otherwise stated, all monies paid are non-refundable and non-transferrable to another student or course, regardless of whether the Registered Course(s) has/have commenced.
Intellectual Property
The Student and the Parent are prohibited from copying, reproducing, modifying, distributing or transmitting in any form or by any means whatsoever (including mechanical, electronic, recording, photocopying, photographing or otherwise) any of EC’s curriculum material (be they worksheets, notes, study materials or other material in whatever form or medium) ("Prohibited Act''). The Student or Parent shall also not instigate, encourage or instruct anyone to carry out the Prohibited Act.
Ember's Chamber may copy, reproduce, display, distribute and use any work / material produced by the Student as part of the Registered Course(s).
Other Conditions
The Parent hereby warrants that the Student is registered for the Registered Course(s) at the same level at which the Student is currently enrolled for in his / her formal education [e.g. if the Student is in P2 at a MOE government primary school, the Student must register for P2 course(s)]. EC does not allow any skipping of levels under any circumstances.
We reserve the right and the sole discretion to, (a) transfer, combine or dissolve a class and change teachers, and/or (b) terminate the Student's place in any of the Registered Course(s).
While EC will take reasonable precautions to ensure the safety of the Student, EC assumes no liability for personal injury, loss or damage to property or any loss or damage of any kind whatsoever which might be sustained by the Student in undertaking any activity or anything during the Registered Course(s), whether under the direction of EC or otherwise, and generally for any such injury, loss or damage however caused except by the wilful default of EC, its servants or agents.
The Parent hereby releases EC, its servants and agents from all liability for such injury, loss or damage of any other kind whatsoever which might be sustained by the Student in undertaking any activity or anything during the Registered Course(s), whether under the direction of EC or otherwise, and generally for any such injury, loss or damage howsoever caused except by the wilful default of EC, its servants and agents.
EC shall not be liable for any default or closure of classes due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond EC’s reasonable control.
It is the Parent's responsibility to monitor the health of their children before they come to the Ember's Chamber for lessons. If the Student is not feeling well, we reserve the right to send him home. The fees in respect of the lesson for that day will not be refunded.
The Course Registration Form and these General Terms contain the whole agreement between the Parent, Student and EC and supersedes any prior written or oral agreement amongst them relating to the Student's enrolment in the Registered Course(s) and the parties confirm that they have not entered into this agreement on the basis of any representations that are not expressly incorporated in the Course Registration Form and these General Terms.
EC reserves the right to use students' information including, but not limited to, their names, level, school, results, photographs & video footages as part of our marketing purposes.
The Parent hereby also consents to the collection, use and disclosure of his / her personal data as well as the personal data of the Student in accordance with the purposes specified in the EMBER'S CHAMBER's Personal Data Protection Policy. For more information, please click here.
