Constitution
of the
Commonwealth of Egan
The Eganese Constitution was written on July 22nd, 2019, along with all of its seven amendments. It was written over two years after the founding of the nation. Experimental constitutions were made in the nation's early days, but none were very well-made. The constitution was revised on December 19th, 2019 due to flaws and lack of clarity.
We the people of the Commonwealth of Egan hereby declare that this nation is based on the pursuit of the musical arts and the rights of the individual.
We the people of the Commonwealth of Egan believe that the individual has certain rights, foremost among them the right to life, the right to free speech, the right to music, freedom of religion, the right to personal security, freedom from discrimination, and the right to wear any attire at any time.
We the people of the Commonwealth of Egan hereby declare that this constitution is the supreme law of the land.
We the people of the Commonwealth of Egan hereby declare the Governor to be the head of state and government for life. His or her successor shall be determined as soon as he or she assumes office, and can change at any time. This successor will take the Governor's place upon his or her abdication or forced removal. Impeachment requires the approval of three fifths of the population as do the creation of new laws and policies, as well as changes to the constitution (not revision). There must be a debate before any motion is passed or rejected between the Governor and a volunteer debater. The debate will take place in Eganese Debate Format and there will be no declared winner. The debaters will have from the announcement of the debate up until the beginning of the debate to prepare before the motion is debated.
Amendments
The First Amendment
The citizen has the right to a prosperous life beginning with exiting the womb and ending with the irreversible stop of the heart. The government must not infringe on freedom of speech, religion, peaceful protest, petitioning, or the press.
The Second Amendment
The citizen has the right to defend his or her self with melee and non-lethal weapons. Firearms require a permit. Criteria for a permit include: being over the age of 20, a four-week-long course, and a lack of criminal record relating to violence. The government may not tax firearm permits at any time. If a citizen commits a violent crime, their firearms and permit will be confiscated.
The Third Amendment
The citizen has the right to a private life. The sexual life of two consenting adults is no business of the government. Government agents require warrants to search a home.
The Fourth Amendment
The citizen has the right to a trial if accused. The burden of proof is on the accuser. The accused is suspected until proven guilty or innocent. The accused has the right to a lawyer. Citizens who are found to have made false accusations will be punished. Trials will be judged by a Senator or a judge appointed by the Senator.
The Fifth Amendment
Citizens cannot be fined more that 8000 Lid. Bail is not permitted. The death penalty or sentences involving physical or psychological torture cannot be given out no matter the gravity of the crime committed.
The Sixth Amendment
Slavery, involuntary servitude, prostitution, or any form of human trafficking is illegal. Child labour is only legal for those over the age of 10. The jobs of minor workers must not interfere with their education and the working conditions must be suitable for their stage of development.
The Seventh Amendment
All citizens may vote in provincial and federal referendums once they pass a political competency test. All citizens must take the test before each referendum. The test must be unbiased. The passing grade is 60%.
