"So that we may evaluate the nature of your complaint and you will be advised accordingly, please file an initial complaint by submitting a duly accomplished complaint form with attached receipt or proof of transaction to DTI Misamis Oriental Provincial Office OR send an email to r10.misamisoriental@dti.gov.ph with the following details:
1. Complete name, address, email, and contact number of complainant;
2. Complete name, address, and contact number (if known) of the business establishment complained of;
3. Narration of Facts;
4. Demand; and
5. Scanned copy of official receipt or other proof of transaction with the business establishment."
Consumer products and services, as defined in R.A. 7394, Title I, Article 4, Section Q., means goods, services and credits, debts or obligations which are primarily for personal, family, household or agricultural purposes, which shall include but not limited to food, drugs, cosmetics, and devices.Â
If the subject of the complaint submitted does not fall under consumer products and services as defined by R.A. 7394, it is not within the ambit of the Consumer Act of the Philippines. Hence, the resolution of the said complaint is beyond the jurisdiction of the Department of Trade and Industry (DTI), as the implementing agency tasked to enforce select provisions under the Consumer Act.
DTI only has jurisdiction on complaints initiated by business entities if the violation involves Lemon Law.
