Disclaimer of WarrantiesThe App and Services are provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the App will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
본 앱 및 서비스는 “있는 그대로(AS IS)” 및 “사용 가능한 상태(AS AVAILABLE)”로, 모든 결함을 포함하여 어떠한 종류의 보증 없이 제공됩니다. 관련 법률이 허용하는 최대 범위 내에서, 당사(그 계열사, 라이선스 제공자 및 서비스 제공자를 포함)는 본 앱에 관하여 명시적·묵시적·법정적 또는 기타 모든 보증을 명확히 배제합니다. 여기에는 상품성, 특정 목적 적합성, 권리·비침해 보증, 거래 관행 등으로 발생할 수 있는 모든 보증이 포함됩니다. 전술한 내용에 제한 없이, 당사는 본 앱이 귀하의 요구사항을 충족하거나, 의도한 결과를 달성하거나, 다른 소프트웨어·시스템과 호환되거나, 중단 없이 작동하거나, 성능·신뢰성 기준을 충족하거나, 오류가 없거나, 오류·결함이 수정될 것이라는 어떠한 보증이나 약속도 하지 않습니다.일부 관할지역에서는 특정 유형의 보증 배제나 소비자 법정 권리 제한을 허용하지 않으므로, 위 배제 및 제한 조항 중 일부가 귀하에게 적용되지 않을 수 있습니다. 다만 이 경우 해당 조항은 관련 법률이 허용하는 최대 범위까지 적용됩니다.
Limitation of LiabilityNotwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the App or 100 USD if You haven’t purchased anything.To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the App, third-party software and/or third-party hardware used with the App, or otherwise in connection with any provision of these Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party’s liability will be limited to the greatest extent permitted by law.
귀하가 입을 수 있는 어떠한 손해에도 불구하고, 본 약관의 어떤 조항에 따른 당사 및 공급자의 총 책임과 귀하의 유일한 구제 수단은 귀하가 본 앱에 대해 실제 지불한 금액(구매하지 않은 경우 100 USD)으로 제한됩니다.관련 법률이 허용하는 최대 범위 내에서, 당사 또는 공급자는 어떠한 경우에도 특별·우발적·간접적·결과적 손해(이익 상실, 데이터 손실, 사업 중단, 신체 상해, 프라이버시 침해 등 본 앱 사용 또는 사용 불능과 관련된 모든 손해 포함)에 대해 책임을 지지 않습니다. 당사 또는 공급자가 그러한 손해 가능성을 사전에 통지받았거나 구제 수단의 본질적 목적이 달성되지 못한 경우에도 마찬가지입니다.일부 관할지역에서는 우발적 또는 결과적 손해 배제·제한을 허용하지 않으므로, 위 제한 중 일부가 적용되지 않을 수 있습니다. 이러한 경우 각 당사자의 책임은 법률이 허용하는 최대 범위로 제한됩니다.
Governing Law and JurisdictionThese Terms and Your use of the App shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles.Any legal action or proceeding arising out of or in connection with these Terms shall be brought exclusively in the courts located in Seoul, Republic of Korea, and You hereby consent to the personal jurisdiction and venue of such courts. Your use of the App may also be subject to other local, state, national, or international laws.Notwithstanding the foregoing, nothing in this section limits any consumer protection rights that You may have under the mandatory laws of Your country of residence (for example, in the EU or certain U.S. states).
본 약관 및 귀하의 앱 사용은 법률 충돌 원칙을 배제하고 대한민국 법률에 따라 규율되고 해석됩니다.본 약관과 관련하여 발생하는 모든 법적 소송 또는 절차는 대한민국 서울 소재 법원에 독점적으로 제기되어야 하며, 귀하는 해당 법원의 속인적 관할권 및 재판적 관할권에 동의합니다. 귀하의 앱 사용은 또한 다른 지방·주·국가 또는 국제 법률의 적용을 받을 수 있습니다.전술한 내용에도 불구하고, 본 조항은 귀하의 거주국 의무적 소비자 보호 권리(예: EU 또는 미국 일부 주)를 제한하지 않습니다.
