These Terms of Use ("Terms") are a legal agreement between you and Serhii Tykhonenko ("we", "us", "the developer") and govern your use of the Docsmith application ("the app"). By downloading or using Docsmith, you agree to these Terms. If you do not agree, please do not use the app.
This agreement is between you and the developer only, not with Apple. Apple is not responsible for the app or its content (see Section 10).
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Docsmith on Apple-branded devices that you own or control, for your own personal use or internal business use with your own documents, in accordance with these Terms and the Apple Media Services Terms and Conditions (including the Licensed Application End User License Agreement, "Standard EULA"). You may not rent, lease, lend, sell, redistribute, or sublicense the app.
2. Your documents and content
Everything you open, create, or edit in Docsmith is yours. It is processed and stored on your device; we do not access, receive, or store a copy (see our Privacy Policy). You are responsible for keeping your own backups. We are not responsible for any loss of documents or data.
Acceptable use - your responsibility for documents
Docsmith is a tool for working with documents. You are solely responsible for the content, accuracy, and lawful use of every document you create, edit, sign, redact, or share with it. You agree that you will not use Docsmith to: create, alter, forge, or falsify any document with intent to deceive, defraud, or misrepresent (including invoices, contracts, financial, legal, identity, or government documents); infringe the intellectual-property, privacy, or other rights of any person; remove or defeat security on documents you are not authorised to modify; or do anything unlawful, or attempt to reverse-engineer, decompile, or interfere with the app's security or operation. Editing, signing, and redaction features are provided for legitimate work with documents you own or are authorised to modify. Any fraudulent or unlawful use is solely your responsibility.
4. Subscriptions and purchases
Docsmith offers an optional Docsmith Pro subscription (monthly or yearly). The yearly plan may begin with a free trial as described in the app.
Billing: prices are shown in the app in your local currency. Payment is charged to your Apple Account at confirmation of purchase.
Auto-renewal: subscriptions renew automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
Free trial: if you buy a plan that includes a free trial and do not cancel at least 24 hours before it ends, the trial automatically converts to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
Managing and cancelling: you can manage or cancel your subscription any time in the Settings app, under your name, Subscriptions. Cancelling stops future renewals; you keep Pro until the end of the paid period.
Refunds: all purchases are processed by Apple. Refund requests are handled by Apple under the Apple Media Services Terms (reportaproblem.apple.com); we cannot issue refunds directly.
Price changes: if we change a subscription price, Apple will notify you and, where required, ask for your consent before the change takes effect.
Intellectual property
The app, its design, and its content (excluding your documents) are owned by the developer and protected by law. These Terms grant you a license to use the app; they do not transfer any ownership rights to you.
6. No warranty
To the maximum extent permitted by law, the app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free or uninterrupted, that OCR or text recognition will be fully accurate, or that it will meet your specific requirements. You use the app at your own risk.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, documents, profits, or goodwill, arising from your use of (or inability to use) the app, even if advised of the possibility. Keep regular backups of your documents.
8. Indemnity
You agree to indemnify and hold the developer harmless from any claim or demand arising out of your misuse of the app or your violation of these Terms, including any claim relating to documents you created, altered, or shared using the app.
Changes and termination
We may update the app and these Terms from time to time. Material changes will be reflected by updating the "Last updated" date on this page. Continued use after changes means you accept the updated Terms. This license ends automatically if you breach these Terms or if you delete the app.
10. Apple App Store
The following apply because Docsmith is distributed through the Apple App Store. These Terms are between you and the developer only, not with Apple; Apple has no obligation to provide maintenance or support for the app. The developer, not Apple, is solely responsible for the app and its content, and for any claims relating to the app (including product-liability, legal or regulatory compliance, and consumer-protection claims), and for addressing any third-party claim that the app infringes intellectual-property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Your use must also comply with the Apple Media Services Terms and any applicable third-party terms.
Governing law
These Terms are governed by the laws applicable in the developer's place of residence, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights in your country of residence.
