Please read these Terms of Use carefully before using the iOS app published by David Cederbaum on the Apple App Store ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
This Agreement Is With Us, Not Apple
These Terms are an agreement between you and David Cederbaum ("we", "us", "our") only, and not with Apple Inc. ("Apple"). We, and not Apple, are solely responsible for the App and its content. Apple is not responsible for the App or for these Terms.
Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, and as permitted by Apple's Family Sharing and volume purchase rules where applicable. This licence is for your personal, non-commercial use unless we agree otherwise in writing.
What You May Not Do
You agree not to copy, modify, translate, or create derivative works of the App; reverse engineer, decompile, or disassemble the App, except where that restriction is prohibited by applicable law; rent, lease, lend, sell, sublicense, or redistribute the App; remove or alter any copyright, trademark, or other proprietary notices; use the App for any unlawful purpose, or in any way that interferes with or damages the App or other users; or attempt to gain unauthorised access to any part of the App or its related systems.
Ownership
The App, including its software, design, text, graphics, and all other content, is owned by us and protected by copyright and other intellectual property laws. These Terms grant you a licence to use the App, not ownership of it. All rights not expressly granted are reserved.
Maintenance and Support
We are solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services for the App. If you need help, contact us at david_cederbaum@icloud.com.
Warranty
The App is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
Product Claims
We, and not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Claims
If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, we, and not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or relating to your use of or inability to use the App, even if we have been advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total liability to you for all claims relating to the App will not exceed the greater of the amount you paid for the App or fifty US dollars.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
Legal Compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Terms
You must comply with any applicable third-party terms of agreement when using the App, for example the terms of your wireless data service plan.
Apple as Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
Termination
This licence is effective until terminated by you or by us. Your rights under these Terms terminate automatically if you fail to comply with any of them. Upon termination, you must stop all use of the App and delete all copies from your devices.
Changes to the App and to These Terms
We may update, modify, or discontinue the App or any of its features at any time. We may also revise these Terms; if we do, we will update the date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which the developer is resident, without regard to its conflict of law provisions. Nothing in this section deprives you of the protection afforded by the mandatory consumer protection laws of the country in which you reside.
