These Terms of Use (“Terms”) govern your use of Daily Affirmations: Soleil (the “App”). By downloading, accessing, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Age

You must be at least 13 years old to use the app. If you are under the legal age of majority where you live, you may use the app only with permission from a parent or legal guardian, who is responsible for approving any purchase made through the Apple Account.

2. App Purpose

The app provides affirmations, motivational quotes, visual themes, exportable images, widgets, and related general-wellness content for personal use.

3. Not Medical or Professional Advice

The app and its content are for general inspiration and wellness only. They do not provide medical, psychological, psychiatric, therapeutic, legal, financial, or other professional advice, diagnosis, or treatment. The app is not a substitute for a qualified professional.

Do not rely on the app for emergency or crisis assistance. If you or another person may be in immediate danger, contact local emergency services or an appropriate qualified professional.

4. License and Acceptable Use

Subject to these Terms and Apple's applicable terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes. The app is licensed, not sold.

You may not:

· copy, modify, reverse-engineer, decompile, or attempt to extract the app's source code except where applicable law expressly permits it;

· resell, sublicense, rent, commercially distribute, or misuse the app;

· redistribute the affirmation library, themes, or other app content as a competing product or bulk content collection;

· circumvent purchase, access-control, or security measures; or

· use the app in an unlawful, fraudulent, abusive, or harmful manner.

5. Free and Premium Features

The app may provide free features and premium features. Premium access may include additional affirmation topics, visual themes, widget sizes or styles, removal of export watermarks, and other features described in the app. Features included in a plan are shown before purchase and may be updated where reasonably necessary.

6. Auto-Renewable Subscriptions

The app may offer monthly and yearly auto-renewable subscriptions. The current localized price, billing period, trial availability, and included features are displayed in the app and Apple purchase sheet before you confirm a purchase.

· Payment is charged to your Apple Account when the purchase is confirmed.

· A subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.

· Your Apple Account may be charged for renewal within 24 hours before the current period ends.

· You can manage or cancel a subscription in your Apple Account subscription settings.

· Deleting the app does not cancel a subscription.

· After cancellation, premium access generally remains available until the end of the paid subscription period, subject to Apple's systems and policies.

7. Free Trial

The yearly subscription may include a 3-day free trial where it is shown and where Apple determines that the user is eligible. Unless cancelled before the trial ends, the trial automatically converts into a paid yearly subscription at the price displayed when the trial was started. Trial eligibility and billing are controlled by Apple. Any unused portion of a trial may be forfeited where applicable.

8. Lifetime Purchase

The app may offer a one-time, non-consumable lifetime purchase. This purchase provides the premium entitlement associated with that product for this app without a recurring subscription fee. "Lifetime" describes the one-time product type and does not guarantee that the app, every feature, or compatibility with future devices and operating systems will continue indefinitely. Mandatory consumer rights remain unaffected.

9. Restore Purchases

Eligible purchases may be restored using Restore Purchase while the device is signed in with the Apple Account used for the original purchase. Restoration depends on Apple's systems, purchase status, and policies.

10. Billing and Refunds

All purchases are processed by Apple. We do not directly receive your payment-card details and generally cannot independently approve or issue App Store refunds. Refund requests, billing disputes, chargebacks, and purchase reversals are handled under Apple's policies and applicable consumer law. Premium access may be removed when Apple reports that a purchase has expired, been refunded, revoked, or reversed.

11. Exported Images

The app may allow you to save or share affirmation cards and wallpapers. You may use exported images for personal, non-commercial use and ordinary social sharing. You may not sell, mass-republish, commercially redistribute, or use the app's content to create a competing content library or product without written permission. You are responsible for how and where you share exported content.

12. Intellectual Property

The App, software, designs, themes, graphics, branding, and included content are owned by or licensed to us and are protected by applicable intellectual-property laws. No ownership right is transferred to you except for the limited license stated in these Terms.

13. Availability, Third-Party Services and Changes

The App relies on services and technologies provided by third parties, including Apple services used for App distribution, purchases, device functionality, and widgets, and Google Firebase services used for analytics, crash reporting, and technical diagnostics.

These third-party services may experience interruptions, errors, changes, or discontinuation outside our control. We do not guarantee uninterrupted availability of the App or any third-party service.

We may maintain, improve, modify, suspend, replace, or discontinue App features where reasonably necessary for technical, security, legal, compatibility, or product reasons.

Use of third-party services may also be subject to the applicable terms and privacy practices of those providers. Information about how the App handles data is described in our Privacy Policy.

Where required by applicable law, changes will not limit consumer rights or paid-service rights that cannot legally be excluded.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the app is provided on an "as is" and "as available" basis. We do not guarantee that the app will be error-free, uninterrupted, or suitable for every individual purpose. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the app. Where liability cannot legally be excluded or limited, it is limited only to the extent permitted by applicable law. These limitations do not apply where prohibited by law.

16. Apple Terms

Your use of the app is also subject to Apple's applicable App Store terms and the Apple Standard End User License Agreement. These Terms supplement Apple's terms. If a provision of these Terms conflicts with a mandatory Apple term, the applicable Apple term controls to the extent of the conflict. Apple is not responsible for providing support for the app except as required by applicable law, and Apple and its subsidiaries may be third-party beneficiaries to the extent provided by Apple's agreements.

17. Suspension or Termination

You may stop using the app at any time. We may restrict access where reasonably necessary because of material misuse, fraud, security risk, legal requirements, or a serious breach of these Terms. Stopping use or deleting the app does not automatically cancel an Apple subscription.

18. Changes to These Terms

We may update these Terms to reflect changes to the app, law, or business practices. The revised page will show a new Last Updated date. Where required, material changes will be communicated in the app. Your continued use after an update constitutes acceptance only to the extent permitted by applicable law.

19. Applicable Law and Disputes

These Terms are governed by applicable law. Any dispute will be handled by a court or authority with competent jurisdiction under applicable law. Nothing in these Terms limits mandatory consumer protections, statutory rights, or any right to bring a claim in a forum that cannot legally be waived in your country or region.
