CreatorKit AI – Terms of Service

Welcome to CreatorKit AI.

These Terms of Service ("Terms") govern your access to and use of the CreatorKit AI mobile application ("CreatorKit AI", "the app", "we", "our", or "us").

By accessing or using CreatorKit AI, you agree to these Terms. If you do not agree with these Terms, please do not use the app.

1. About CreatorKit AI

CreatorKit AI is an AI-powered content creation application designed to assist users in creating text-based social media content.

Features may include:

• Social media captions
• Hashtags
• Image prompts
• Content ideas
• Posting schedules
• Reel and video scripts
• Complete social media posts
• Other AI-powered creator tools

CreatorKit AI primarily generates text-based content and does not currently generate images or videos.

Features may be added, changed, limited, or removed as the service develops.

2. User Accounts

Some or all features of CreatorKit AI require you to sign in using a supported authentication method, such as Google Sign-In.

You are responsible for maintaining the security of your account and for activity performed through your account.

You must provide accurate information when using the service and must not attempt to access another person's account without authorization.

3. AI-Generated Content

CreatorKit AI uses artificial intelligence services to generate content based on information and instructions provided by users.

AI-generated content may sometimes be inaccurate, incomplete, inappropriate, outdated, repetitive, or unsuitable for your intended purpose.

You are responsible for reviewing AI-generated content before publishing, sharing, relying upon, or otherwise using it.

CreatorKit AI does not guarantee the accuracy, originality, availability, effectiveness, engagement, performance, or suitability of AI-generated content.

AI-generated suggestions, including posting schedules or recommended posting times, do not guarantee social media reach, engagement, followers, sales, revenue, or other results.

4. Responsible Use

You agree to use CreatorKit AI responsibly and in accordance with applicable laws and regulations.

You must not use CreatorKit AI to create, request, distribute, or facilitate content that:

• Is illegal or promotes illegal activity
• Exploits or sexually abuses children
• Promotes violence, terrorism, or serious harm
• Encourages self-harm or other dangerous behavior
• Harasses, threatens, bullies, or unlawfully discriminates against others
• Facilitates fraud, scams, impersonation, or deceptive behavior
• Violates intellectual property or other rights of another person
• Contains malicious code or facilitates unauthorized access to systems
• Violates applicable Google Play policies or other applicable platform rules

We may restrict or terminate access to CreatorKit AI where we reasonably believe the service is being misused.

5. Your Content and Inputs

You retain responsibility for the information, prompts, topics, descriptions, and other material you submit to CreatorKit AI.

You should not submit passwords, payment credentials, highly sensitive personal information, confidential information, or other information that you do not have the right to process.

Information submitted for AI generation may be processed by third-party AI service providers as described in our Privacy Policy.

You represent that you have the necessary rights or permissions to submit content you provide to the app.

6. Use of Generated Content

CreatorKit AI is intended to assist with content creation. You are responsible for determining whether generated content can legally and appropriately be used for your intended purpose.

You should review generated content for potential copyright, trademark, privacy, advertising, platform-policy, factual, or other legal issues before publishing it.

CreatorKit AI does not guarantee that generated content will be unique or that similar content will not be generated for other users.

7. Free and Premium Services

CreatorKit AI may provide both Free and Premium access.

Free users may have limits on AI generations and may see advertisements.

Premium users may receive additional features, higher AI generation limits, and other benefits described within the app.

Current features, limits, and Premium benefits may change over time. Material changes affecting an existing paid subscription will be handled in accordance with applicable law and Google Play requirements.

8. Premium Subscriptions

Premium subscriptions purchased through the Android application are processed and managed through Google Play.

Available plans, prices, billing periods, benefits, and applicable subscription terms will be displayed before purchase.

Subscriptions may automatically renew unless cancelled before the applicable renewal date, subject to the terms shown during purchase and the rules of Google Play.

You can manage or cancel your subscription through your Google Play account.

Deleting your CreatorKit AI account does not automatically cancel a subscription managed by Google Play. You should cancel an active subscription through Google Play if you do not want it to renew.

Refunds and payment-related matters are subject to applicable law and Google Play's policies and procedures.

9. AI Generation Limits

CreatorKit AI may apply limits to the number of AI generations available during a specified period.

Different limits may apply to Free and Premium users.

Generation limits, reset periods, and other usage restrictions may be displayed within the app and may change as the service develops.

Attempts to circumvent usage restrictions or abuse the service may result in restricted access.

10. Advertising

CreatorKit AI may display advertisements, particularly to users of the Free plan.

Advertising may be provided through third-party advertising services. Information regarding advertising and related data practices is described in our Privacy Policy.

11. Third-Party Services

CreatorKit AI relies on third-party services that may include authentication providers, AI providers, Firebase services, Google Play, advertising providers, and other technology services.

Your use of certain third-party services may also be subject to their respective terms and policies.

We are not responsible for interruptions or changes caused by third-party services that are outside our reasonable control.

12. Intellectual Property

CreatorKit AI, including its application design, branding, software, logos, and other proprietary materials, is protected by applicable intellectual property laws.

These Terms do not grant you ownership of CreatorKit AI or its underlying software, branding, or technology.

You may not copy, modify, reverse engineer, redistribute, sell, or commercially exploit the app or its proprietary components except where permitted by applicable law.

13. Service Availability

We aim to provide a reliable service but cannot guarantee that CreatorKit AI will always be available, uninterrupted, secure, or error-free.

Features may temporarily become unavailable because of maintenance, technical problems, third-party service interruptions, usage limits, updates, or other circumstances.

14. Account Suspension and Termination

We may suspend, restrict, or terminate access to CreatorKit AI where reasonably necessary, including for violations of these Terms, misuse of the service, fraudulent activity, security concerns, or legal requirements.

You may stop using CreatorKit AI at any time and may request deletion of your account as described in our Privacy Policy and Account & Data Deletion page.

15. Disclaimer

CreatorKit AI is provided on an "as available" basis to the extent permitted by applicable law.

AI-generated content is provided as an assistive tool and should not be treated as professional legal, financial, medical, or other professional advice.

To the extent permitted by applicable law, we disclaim warranties regarding the accuracy, reliability, suitability, availability, or results of the service or AI-generated content.

16. Limitation of Liability

To the extent permitted by applicable law, CreatorKit AI and its developer will not be liable for indirect, incidental, special, consequential, or similar damages resulting from your use of or inability to use the app or AI-generated content.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Privacy

Your use of CreatorKit AI is also subject to the CreatorKit AI Privacy Policy, which explains how information is collected, used, processed, retained, and protected.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to CreatorKit AI, its features, applicable laws, or service requirements.

When these Terms are updated, the Effective Date at the top of this page will be updated.

Continued use of CreatorKit AI after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
