אנא קרא תנאי שימוש אלו בעיון לפני השימוש באפליקציה קל-קאונטר+AI ("האפליקציה" או "השירות"). השימוש באפליקציה מהווה הסכמה מלאה לתנאים המפורטים להלן.

1. הגדרות

• המפתח / אנחנו — אייל, יוצר ומפתח האפליקציה.

• שירות / אפליקציה — אפליקציית קל-קאונטר+AI לניהול תזונה ומעקב קלוריות.

• משתמש / אתה — כל אדם המשתמש באפליקציה.

• מכשיר — כל אמצעי טכנולוגי המאפשר גישה לשירות (טלפון, טאבלט, מחשב).

• תנאים — תנאי שימוש אלו.

2. קבלת התנאים

השימוש באפליקציה קל-קאונטר+AI מהווה הסכמה לתנאי שימוש אלו. אם אינך מסכים לתנאים, אנא הפסק להשתמש באפליקציה.

3. כשירות גיל

השירות מיועד למשתמשים בני 13 ומעלה. משתמשים מתחת לגיל 18 נדרשים לקבל אישור הורה או אפוטרופוס. בשימושך באפליקציה, אתה מצהיר כי עמדת בדרישות אלו. 

4. תיאור השירות

קל-קאונטר+AI היא אפליקציה לניהול תזונה ומעקב קלוריות המשתמשת בטכנולוגיית בינה מלאכותית לצורך חישוב יעדים תזונתיים אישיים.

5. פרטיות

השימוש באפליקציה כפוף גם למדיניות הפרטיות שלנו, המפרטת כיצד אנו אוספים, משתמשים ומגנים על המידע האישי שלך. מומלץ לקרוא אותה בעיון.

6. אחריות רפואית — הבהרה חשובה

⚠️ האפליקציה מיועדת למטרות מידע כלליות בלבד ואינה מהווה ייעוץ רפואי, תזונתי או מקצועי. יש להתייעץ עם רופא או תזונאי מוסמך לפני ביצוע שינויים משמעותיים בתזונה. המפתח אינו אחראי לכל נזק, ישיר או עקיף, הנובע מהסתמכות על המידע באפליקציה.

7. מנויים ותשלומים

האפליקציה עשויה להציע תכניות בתשלום. ברכישת מנוי או תשלום כלשהו, אתה מסכים לשלם את הסכום הרלוונטי בהתאם לתוכנית שנבחרה. החזרים מעובדים בהתאם למדיניות פלטפורמת הרכישה (App Store / Google Play). באחריותך לבטל מנוי אם אינך מעוניין להמשיך בו. 

8. שימוש מותר והגבלות

אנו מעניקים לך רישיון מוגבל, אישי, לא בלעדי ולא ניתן להעברה לשימוש באפליקציה למטרות פרטיות בלבד.

אינך רשאי:

• להעתיק, לשכפל, למכור או להפיץ את האפליקציה או כל חלק ממנה

• לנסות לבצע הנדסה לאחור או לחלץ את קוד המקור

• להשתמש באפליקציה לכל מטרה בלתי חוקית

• לפגוע או לשבש את פעילות האפליקציה

9. קניין רוחני

כל זכויות הקניין הרוחני של האפליקציה, כולל עיצוב, קוד ותוכן, שייכות לאייל. אין להעתיק, לשכפל או להפיץ כל חלק מהאפליקציה ללא אישור מפורש בכתב.

10. שירותי צד שלישי

האפליקציה עשויה לכלול קישורים לשירותים חיצוניים. המפתח אינו אחראי לתכנים, למדיניות פרטיות או לפעולות של שירותים אלו. השימוש בהם נעשה על אחריותך בלבד.

11. זמינות השירות

המפתח אינו מתחייב כי האפליקציה תהיה זמינה בכל עת ללא הפרעות. המפתח שומר לעצמו את הזכות לשנות, להשעות או להפסיק את האפליקציה בכל עת, עם או בלי הודעה מוקדמת.

12. אחריות מוגבלת

האפליקציה מסופקת "כפי שהיא" (AS IS) ללא אחריות מכל סוג, מפורשת או משתמעת. המפתח אינו מתחייב לדיוק, שלמות, או התאמה למטרה מסוימת של התוכן המוצג, ואינו אחראי לנזקים ישירים, עקיפים, נלווים או תוצאתיים, לרבות אובדן מידע, פגיעה בריאותית או נזק הנובע מהסתמכות על תכני השירות.

13. שיפוי

אתה מתחייב לשפות ולפצות את המפתח בגין כל תביעה, נזק, הפסד או הוצאה (לרבות שכר טרחה משפטי) הנובעים מהפרת תנאים אלו או מהשימוש הבלתי תקין שלך בשירות.

14. סיום גישה

המפתח רשאי להפסיק או להשעות את גישתך לאפליקציה בכל עת, ללא הודעה מוקדמת, במקרה של הפרת תנאים אלו. עם הסיום, תופסק זכותך להשתמש בשירות באופן מיידי.

15. הפרדת סעיפים

אם יימצא שסעיף כלשהו בתנאים אינו תקף או אינו ניתן לאכיפה, יתוקן ככל האפשר ושאר התנאים יישארו בתוקף מלא.

16. שינויים בתנאים

המפתח שומר לעצמו את הזכות לעדכן תנאי שימוש אלו בכל עת. במקרה של שינויים מהותיים, תישלח הודעה מוקדמת של לפחות 30 ימים. המשך שימוש באפליקציה לאחר כניסת השינויים לתוקף מהווה הסכמה לתנאים המעודכנים.

17. דין חל וסמכות שיפוט

תנאי שימוש אלו כפופים לחוקי מדינת ישראל. כל מחלוקת הנובעת מתנאים אלו תובא להכרעה בבתי המשפט המוסמכים בתל אביב בלבד.

• User / You — Any individual who uses the App.

2. Acceptance of Terms

By using the Kal-Counter+AI application, you agree to these Terms of Service. If you do not agree, please discontinue use of the App.

3. Eligibility

The Service is intended for users aged 13 and older. Users under the age of 18 must have parental or guardian consent. By using the App, you confirm that you meet these requirements.

Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. We encourage you to read it carefully.

6. Medical Disclaimer — Important Notice

⚠️ The App is intended for general informational purposes only and does not constitute medical, nutritional, or professional health advice. Consult a physician or qualified nutritionist before making significant dietary changes. The Developer is not responsible for any direct or indirect harm resulting from reliance on information provided by the App.

7. Subscriptions and Payments

The App may offer paid plans. By making any purchase or subscribing, you agree to pay the applicable fees for the plan you selected. Refunds are processed in accordance with the refund policy of the applicable purchase platform (App Store / Google Play). You are responsible for canceling any subscription if you no longer wish to use the Service. 

8. Permitted Use and Restrictions

We grant you a limited, personal, non-exclusive, non-transferable license to use the App for personal purposes only.

You may not:

• Copy, reproduce, sell, or distribute the App or any part of it

• Reverse-engineer or attempt to extract the source code

• Use the App for any unlawful purpose

• Interfere with or disrupt the functionality of the App

9. Intellectual Property

All intellectual property rights in the App, including design, code, and content, belong to Eyal. No part of the App may be copied, reproduced, or distributed without explicit written permission.

10. Third-Party Services

The App may include links to external services or platforms. The Developer is not responsible for the content, privacy practices, or conduct of such services. Use them at your own risk.

11. Service Availability

The Developer does not guarantee that the App will be available at all times without interruption. The Developer reserves the right to modify, suspend, or discontinue the App at any time, with or without notice.

12. Limitation of Liability

The App is provided "AS IS" without warranty of any kind, express or implied. The Developer makes no representations regarding the accuracy, completeness, or fitness for a particular purpose of the content displayed, and is not liable for any direct, indirect, incidental, or consequential damages, including loss of data, health-related consequences, or harm arising from reliance on the App's content.

13. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your improper use of the Service.

14. Termination

The Developer may terminate or suspend your access to the App at any time without prior notice in the event of a breach of these Terms. Upon termination, your right to use the Service ceases immediately.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the extent necessary, and the remaining provisions will continue in full force and effect.

16. Changes to Terms

The Developer reserves the right to update these Terms at any time. For material changes, at least 30 days' advance notice will be provided. Continued use of the App after the effective date of any changes constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. Any disputes arising from these Terms shall be resolved exclusively in the competent courts of Tel Aviv, Israel.
