The Official Bruskarian Controlled Substances Act

This Act establishes the laws governing controlled substances within the territories of the Grand Duchy of Bruskaria.

The purpose of this Act is to regulate substances capable of causing intoxication, dependence, impairment, or significant harm while establishing clear conditions for their lawful possession, acquisition, sale, and use.
}{ III
This Act applies to all citizens, residents, visitors, businesses, and other persons present within Bruskaria except where another Act expressly provides otherwise.
}{ IV
For the purposes of this Act, a controlled substance includes any substance or product whose possession, acquisition, sale, distribution, production, or consumption is specifically regulated by Bruskarian law.
}{ I
The minimum age for purchasing, possessing for personal consumption, or consuming an alcoholic beverage containing no more than five percent alcohol by volume shall be fifteen years.
}{ II
The minimum age for purchasing, possessing for personal consumption, or consuming an alcoholic beverage containing more than five percent but no more than ninety percent alcohol by volume shall be seventeen years.
}{ III
Alcoholic products containing more than ninety percent alcohol by volume shall not be sold or supplied for consumption as beverages.
}{ IV
The possession or use of alcohol exceeding ninety percent alcohol by volume for legitimate scientific, industrial, medical, cleaning, or other non-consumption purposes shall not be prohibited solely by }{ III.
}{ V
No person shall knowingly sell or supply alcohol to another person who does not satisfy the applicable minimum age established by this Article.
}{ I
The minimum age for purchasing, possessing, or using cigarettes, cigars, pipe tobacco, or other combustible tobacco products shall be sixteen years.
}{ II
No person shall knowingly sell or supply a combustible tobacco product to a person under sixteen years of age.
}{ III
Smoking may be prohibited within designated government buildings, enclosed public facilities, or other locations where necessary to protect persons from involuntary exposure to smoke.
}{ I
The minimum age for purchasing, possessing, or using vaping products shall be fourteen years.
}{ II
For the purposes of this Article, vaping products include electronic cigarettes, disposable vapes, refillable vaping devices, e-liquids containing nicotine, and comparable products intended for inhalation through an electronic device.
}{ III
No person shall knowingly sell or supply a vaping product to a person under fourteen years of age.
}{ IV
The government may establish reasonable restrictions concerning vaping within enclosed government facilities, schools, public transportation, or other designated locations.
}{ I
The minimum age for lawful possession or consumption of cannabis shall be eighteen years.
}{ II
A person aged eighteen years or older may lawfully possess no more than twenty grams of cannabis for personal use.
}{ III
Possession exceeding the lawful personal limit may constitute an offence unless otherwise authorized by law.
}{ IV
The cultivation of cannabis without a valid certificate or other authorization issued by the competent Bruskarian authority is prohibited.
}{ V
Unauthorized commercial sale or distribution of cannabis is prohibited.
}{ VI
Nothing in this Article shall prohibit possession, cultivation, or handling specifically authorized for lawful scientific, medical, governmental, or other approved purposes.
}{ I
A substance may be designated as controlled or prohibited by Bruskarian law where its unrestricted possession or distribution presents a substantial risk to public health or safety.
}{ II
Controlled drugs not otherwise regulated by this Act may be assigned to legal classifications established by subsequent legislation or regulation.
}{ III
Such classifications may establish different rules concerning:
A. Possession;
B. Personal use;
C. Sale and distribution;
D. Production or cultivation;
E. Importation or exportation;
F. Scientific or medical use; and
G. Minimum age requirements.
}{ IV
No person shall be punished for possession of a substance merely because it is intoxicating or psychoactive unless its possession or use is prohibited or regulated by law.
}{ I
A person or business selling a controlled substance shall comply with all minimum-age requirements applicable to that substance.
}{ II
Where the purchaser's age cannot reasonably be determined, the seller may require valid proof of age before completing the transaction.
}{ III
Knowingly providing false identification or materially false age information for the purpose of unlawfully obtaining an age-restricted controlled substance is prohibited.
}{ IV
No person shall knowingly sell a controlled substance represented as another substance or deliberately misrepresent its identity or composition.
}{ V
The government may require licences or certificates for the commercial sale or distribution of particular controlled substances.
}{ I
Lawful possession or consumption of a controlled substance does not exempt a person from laws governing their subsequent conduct.
}{ II
A person who becomes intoxicated or impaired remains legally responsible for offences committed while voluntarily intoxicated or impaired, except where otherwise established by law.
}{ III
No person shall operate a motor vehicle or other dangerous machinery while impaired to an extent that renders safe operation unreasonable.
}{ IV
Consumption or use of particular controlled substances may be prohibited within designated government facilities, schools, workplaces, public transportation, or other locations where reasonably necessary for public safety.
}{ I
No person shall knowingly sell, supply, or otherwise provide an age-restricted controlled substance to a person below the applicable minimum age.
}{ II
A person shall not intentionally use another person below the applicable minimum age to purchase or obtain a controlled substance on their behalf.
}{ III
A minor who is below the applicable minimum age shall not knowingly use another person to unlawfully purchase an age-restricted controlled substance on their behalf.
}{ IV
Nothing in this Article shall prohibit legitimate emergency, medical, scientific, or other uses expressly authorized by law.
}{ I
No person shall operate a motor vehicle while their ability to operate it safely is substantially impaired by alcohol, cannabis, or another intoxicating substance.
}{ II
No person shall knowingly operate dangerous machinery, handle hazardous materials, or perform another safety-critical activity while substantially impaired where doing so creates an unreasonable danger to another person.
}{ III
More specific limits and procedures concerning impaired driving may be established under a Road Traffic Act or other applicable legislation.
}{ I
A controlled substance may be possessed, handled, stored, or used for legitimate scientific, medical, forensic, educational, industrial, or governmental purposes where appropriately authorized.
}{ II
Authorization granted under this Article shall not permit use or distribution beyond the purposes for which authorization was granted.
}{ III
Persons handling controlled substances under an authorization shall take reasonable precautions against unauthorized access, theft, accidental exposure, or unlawful distribution.
}{ I
A controlled substance may be seized where there are reasonable grounds to believe that:
A. Its possession is unlawful;
B. It is being unlawfully sold or distributed;
C. It constitutes evidence relevant to an offence; or
D. Seizure is otherwise specifically authorized by law.
}{ II
Lawfully possessed substances shall not be permanently confiscated without lawful justification.
}{ III
A substance that cannot lawfully be returned may be safely destroyed or otherwise disposed of following the completion of any relevant legal proceedings.
}{ I
Minor violations of this Act may be punished by a warning, fine, confiscation of unlawfully possessed substances, or another proportionate penalty permitted by law.
}{ II
Serious violations involving unauthorized commercial distribution, deliberate supply to persons below an applicable minimum age, repeated offending, or conduct creating substantial danger may result in larger fines or imprisonment as permitted by Bruskarian law.
}{ III
A person who unlawfully sells or distributes a substance while deliberately misrepresenting its identity or composition may be subject to an increased penalty where that deception creates a substantial risk of harm.
}{ IV
Penalties imposed under this Act shall be proportionate to the quantity involved, the offender's intent, the substance concerned, whether commercial distribution occurred, the danger created, and any harm caused.
}{ I
The National Security Corps and other authorized Bruskarian law-enforcement bodies may enforce this Act within their respective jurisdictions.
}{ II
Controlled substances seized during lawful enforcement shall be appropriately secured until they may lawfully be returned, used as evidence, transferred, or destroyed.
}{ III
Nothing in this Act grants law-enforcement personnel authority exceeding that provided by the Constitution or other Bruskarian law.
}{ I
The Ministry of Law shall be the principal ministry responsible for the legal interpretation and administration of this Act.
}{ II
Nothing in this Act shall supersede the Constitution of the Grand Duchy of Bruskaria.
}{ III
Where another Act establishes a more specific rule concerning a substance or activity regulated by this Act, the more specific provision shall apply to the extent of any conflict.
}{ IV
This Act shall enter into force upon its lawful enactment and promulgation.
