Welcome to Biobird Flashcards (“App”). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the App.

1. User Accounts

1.1 Account Creation: To use certain features of the App, you must create an account by signing in with your Google account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

1.2 Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

2. Usage Rights

2.1 License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

2.2 Prohibited Activities: You agree not to:

• Use the App for any illegal or unauthorized purpose.

• Modify, adapt, hack, or reverse-engineer the App.

• Interfere with or disrupt the operation of the App or servers/networks connected to the App.

3. In-App Purchases

3.1 Subscription Plans: The App offers subscription plans that provide access to additional features and content. By purchasing a subscription, you agree to the pricing, payment, and billing policies provided at the time of purchase.

3.2 Refund Policy: All purchases are final and non-refundable, except as required by applicable law. If you have any issues with your purchase, please contact our support team at kbexvee@gmail.com 

4. Content

4.1 User Content: You may be able to submit, post, or share content (e.g., custom tags) through the App. You retain all rights to your content, but you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the App.

4.2 Prohibited Content: You agree not to submit content that is offensive, illegal, or violates the rights of others.

5. Privacy

5.1 Data Collection: We collect and use your personal information as described in our Privacy Policy. By using the App, you consent to our data practices.

5.2 Data Security: We implement reasonable security measures to protect your personal information. However, we cannot guarantee the security of your data transmitted to the App.

6. Termination

6.2 Termination by Us: We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if you violate these Terms or engage in any prohibited activity.

7. Disclaimer of Warranties

The App is provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Effective Date” at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
