1. The Better Philippines Role (Neutrality)

Better PH Association ("the Association") provides a digital platform (the "Platform") intended to facilitate accessibility audits under Batas Pambansa Blg. 344. The Association is a technology provider, not a government agency, regulator, or legal advisor. By using this Platform, you acknowledge that the Association does not perform audits, issue enforcement orders, or render legal advice. All professional certifications are the sole responsibility of the Licensed Professionals (Architects) using the Platform.

2. Separation of Duties

The Platform is built on a tripartite structure. Users agree to respect these functional boundaries:

• Citizen Observers are responsible for the accuracy of raw data submitted.

• Licensed Professionals are responsible for the adjudication, interpretation, and professional sign-off of all compliance reports.

• LGUs are responsible for the enforcement of all compliance reports generated via the Platform. Any attempt to bypass this separation (e.g., unauthorized access or collusion) is a violation of these Terms and may result in the permanent suspension of account access.

3. Professional Liability & Indemnity

The Licensed Professional’s Justification Memo feature is provided as a tool to assist in the documentation of professional judgment. The Association makes no warranty, express or implied, regarding the legal outcome of any audit or appeal. The Licensed Professional retains full and sole liability for their professional stamp and signature. By using the Platform, the user agrees to indemnify and hold harmless the Better PH Association from any claims arising from the user’s professional actions, omissions, or the results of any specific audit.

4. Data Use & Membership

• Membership: Membership in the Better PH Network is a privilege, not a right. We reserve the right to revoke access to any user, chapter, or LGU that compromises the integrity of the audit process.

• Intellectual Property: All software, methodologies, and branding associated with the Platform are the exclusive property of the Better PH Association.

• System Integrity: Users agree not to attempt to reverse-engineer, scrape, or interfere with the automated adjudication and credit-based systems.

5. Disclaimer of Liability

The Platform is provided "as is." While we strive for 100% uptime and data accuracy, the Association is not liable for:

• Discrepancies between physical site conditions and submitted digital data.

• Political or administrative decisions made by LGUs based on audit reports.

• Legal or civil challenges between private establishments and regulatory bodies.

Acceptance of Terms

By creating an account, accessing the UAP Chapter portal, or submitting data as a Citizen Observer, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use.
