TERMS OF USE
BeatMaker: Music & Drum Pads
Last updated: October 3, 2026
These Terms of Use (“Terms”) govern your access to and use of the BeatMaker: Music & Drum Pads mobile application (“BeatMaker,” “the App,” “we,” “us,” or “our”), distributed through the Apple App Store by the developer account that publishes BeatMaker: Music & Drum Pads (the “Publisher”).
By downloading, accessing, or using BeatMaker: Music & Drum Pads, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
These Terms are a binding agreement for App Store users. They are not a substitute for advice from a licensed attorney in your jurisdiction.
1. THE SERVICE
BeatMaker: Music & Drum Pads is a music-creation app that may include, without limitation:
• Soundpacks and pad-based performance
• Songs, guided lessons, and game-style practice modes
• Studio tools for assembling sounds across packs
• Effects, mixer controls, tempo/key tools, and recording/export features
• Optional Premium subscriptions that unlock additional content or features
Features may change over time. We may add, modify, or discontinue features for any reason.
2. ELIGIBILITY AND DEVICE REQUIREMENTS
You must be able to form a binding contract under applicable law. If you are under the age of majority where you live, you may use the App only with the consent of a parent or legal guardian who agrees to these Terms.
You need a compatible Apple device, a supported iOS/iPadOS version, and (for purchases) a valid Apple ID. You are responsible for your device, internet connection, and Apple account.
3. LICENSE TO USE THE APP
Subject to these Terms, the Publisher grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use BeatMaker on Apple devices that you own or control, as permitted by the Apple Media Services Terms and App Store rules.
You may not:
• Copy, modify, distribute, sell, lease, sublicense, or reverse engineer the App, except to the extent such restriction is prohibited by law
• Bypass, disable, or interfere with security, entitlement, or subscription systems
• Scrape, bulk-download, or extract sound libraries for use outside the App except as expressly allowed in Section 5
• Use the App for unlawful, harmful, infringing, or abusive purposes
• Misrepresent your identity or affiliation in connection with the App
4. ACCOUNTS
BeatMaker does not require a separate BeatMaker account. Access to paid features is tied to your Apple ID purchases and subscription status. You are responsible for activity under your Apple ID on your devices.
5. CONTENT AND INTELLECTUAL PROPERTY
5.1 Our content
The App, including software, soundpacks, samples, loops, songs, lesson content, artwork, trademarks, and other materials (collectively, “App Content”), is owned by the Publisher or its licensors and is protected by intellectual property laws.
5.2 License to App Content (personal use)
Subject to these Terms and any Premium entitlements, you may use App Content inside BeatMaker to create and perform music for personal, non-commercial enjoyment.
Unless a specific pack or feature expressly states otherwise in writing:
• You may not redistribute, resell, sublicense, or commercially release the original App Content (samples, loops, stems, songs, or packs) as a standalone sound library, sample pack, or competing product
• You may record your performances and share recordings you create, provided you do not claim ownership of the underlying App Content itself and you comply with platform rules where you share
• Commercial release of your recordings that incorporate App Content may require additional rights; if you need commercial clearance, do not assume the App grants a full commercial sample license unless expressly stated for that content
5.3 Your recordings and projects
You retain rights in the original elements of performances and arrangements you create with the App (“Your Content”), subject to the Publisher’s and licensors’ rights in the underlying App Content. You are responsible for Your Content and for any sharing you initiate.
5.4 Feedback
If you send ideas or feedback about BeatMaker, you grant the Publisher a worldwide, royalty-free, perpetual license to use that feedback without obligation to you.
6. SUBSCRIPTIONS AND PURCHASES
BeatMaker may offer auto-renewable subscriptions (for example, weekly, monthly, or yearly) and other in-app purchases.
• Payment is charged to your Apple ID at confirmation of purchase
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple ID Account Settings
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription
• Prices may vary by storefront and are shown in the App Store at the time of purchase
• Refunds are handled by Apple under Apple’s refund policies; the Publisher does not process card payments directly
Deleting the App does not automatically cancel a subscription. You must cancel through Apple.
7. FREE AND PREMIUM ACCESS
Some packs, songs, lessons, recording, or Studio features may be free; others may require Premium. We may change which content is free or paid, provided we do not strip paid entitlements you already purchased for the period they cover, except as allowed by law or Apple’s rules.
8. ACCEPTABLE USE
You agree not to use BeatMaker to:
• Violate any law or third-party right
• Infringe copyrights, trademarks, or other IP
• Transmit malware or interfere with the App or related services
• Attempt unauthorized access to systems, content, or other users’ data
• Use automated means to abuse analytics, trials, or subscriptions
9. THIRD-PARTY SERVICES
The App may rely on third-party services (for example, Apple, subscription infrastructure, analytics/crash reporting). Those services are subject to their own terms and privacy policies. The Publisher is not responsible for third-party services outside its reasonable control.
10. DISCLAIMERS
BEATMAKER IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that content will meet your creative or commercial goals.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLISHER’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO THE PUBLISHER VIA THE APP STORE FOR BEATMAKER ACCESS IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) ZERO IF YOU HAVE ONLY USED FREE FEATURES.
Some jurisdictions do not allow certain limitations; in those places, liability is limited to the fullest extent permitted.
12. INDEMNITY
To the extent permitted by law, you agree to indemnify and hold harmless the Publisher from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your sharing of Your Content.
13. TERMINATION
These Terms apply until terminated. You may stop using the App at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the App. Provisions that by their nature should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.
Ending access does not cancel Apple subscriptions unless you cancel them with Apple.
14. APPLE-SPECIFIC TERMS
You acknowledge that:
• These Terms are between you and the Publisher, not Apple
• Apple has no obligation to provide maintenance or support for BeatMaker
• Apple is not responsible for any product warranties (to the extent any warranty exists despite the disclaimers above); if BeatMaker fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price as required by Apple’s policies, and to the maximum extent permitted by law Apple has no other warranty obligation
• Apple is not responsible for addressing claims relating to the App (including product liability, legal/regulatory compliance, and consumer protection claims)
• Apple is not responsible for investigating, defending, settling, or discharging third-party IP infringement claims related to the App
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
• You must comply with applicable third-party terms when using the App
15. CHANGES TO THE TERMS
We may update these Terms from time to time. The “Last updated” date will change when we do. If changes are material, we may provide notice in the App or on the App Store listing where practical. Continued use after the effective date constitutes acceptance, except where applicable law requires otherwise.
16. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws applicable to the Publisher’s App Store distribution and the laws of the country or state required by mandatory consumer protection rules in your place of residence. Nothing in these Terms limits non-waivable consumer rights.
If a dispute arises, you agree to first contact the Publisher through the App Store product page support channel and attempt good-faith resolution. If unresolved, disputes will be handled in a forum with proper jurisdiction consistent with applicable law and Apple’s platform rules.
17. MISCELLANEOUS
• If any provision is unenforceable, the remaining provisions remain in effect
• Failure to enforce a provision is not a waiver
• These Terms, together with the Privacy Policy and EULA, are the entire agreement regarding the App
• You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of the App
18. CONTACT
For questions about these Terms, contact the Publisher through the support options on the BeatMaker: Music & Drum Pads Apple App Store product page. No personal email address is listed in this document.
