END USER LICENSE AGREEMENT (EULA)
BeatMaker: Music & Drum Pads
Last updated: October 3, 2026
This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “User”) and the publisher of the BeatMaker: Music & Drum Pads mobile application (the “Licensor,” “we,” “us,” or “our”) for the BeatMaker: Music & Drum Pads software application (“BeatMaker”), including its sound content, features, updates, and related documentation (collectively, the “Software”).
By downloading, installing, or using the Software, you agree to this EULA, the Terms of Use, and the Privacy Policy. If you do not agree, do not install or use the Software.
If Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”) also applies by default through the App Store, this custom EULA governs to the extent it is permitted and presented as the BeatMaker: Music & Drum Pads EULA on the product page and in the App. Where mandatory Apple platform terms conflict, Apple’s required terms control for App Store distribution.
1. LICENSE GRANT
Subject to your compliance with this EULA and payment of any applicable fees, Licensor grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
• Download and install the Software on Apple-branded products that you own or control; and
• Use the Software for personal entertainment and music creation as permitted by the App Store Rules and this EULA.
This is a license, not a sale. Licensor and its licensors retain all right, title, and interest in the Software.
2. LICENSE RESTRICTIONS
Except as expressly allowed by this EULA or mandatory law, you may not:
• Copy, modify, adapt, translate, or create derivative works of the Software’s code or protected assets for redistribution
• Reverse engineer, decompile, or disassemble the Software, except where such restriction is unenforceable
• Rent, lease, lend, sell, redistribute, or sublicense the Software
• Remove proprietary notices from the Software
• Use the Software to develop a competing sound library by extracting and redistributing bundled samples/loops outside the Software
• Circumvent Premium entitlements, trial limits, or security mechanisms
• Use the Software in violation of law or third-party rights
3. SOUND CONTENT LICENSE
The Software includes soundpacks, samples, loops, songs, and related audio/visual materials (“Sound Content”).
You may:
• Perform and arrange Sound Content inside the Software
• Record your performances and share recordings you create, subject to the Terms of Use and any platform rules where you share
You may not, unless expressly authorized in writing for specific content:
• Resell or redistribute Sound Content as stems, one-shots, construction kits, or sample packs
• Claim ownership of Sound Content itself
• Use Sound Content in a way that suggests endorsement by Licensor or its licensors
Your original performance contributions remain yours, subject to Licensor’s rights in the underlying Sound Content.
4. UPDATES AND CHANGES
Licensor may provide updates, patches, or new versions. Updates may be required for continued compatibility or security. Licensor may modify or discontinue features, content catalogs, or the Software, subject to applicable law and any ongoing paid subscription rights for the current paid period.
5. IN-APP PURCHASES AND SUBSCRIPTIONS
Certain features or content may require purchase or an auto-renewable subscription processed by Apple.
• Billing, renewal, cancellation, and refunds are handled under Apple’s terms and policies
• Your license to Premium features lasts only while your entitlement remains active (and any applicable paid period remains valid)
• Failure to renew may result in loss of access to Premium-locked content or features
Details of plans and prices are shown in the App Store / purchase sheet at the time of purchase.
6. PRIVACY
Use of the Software is also governed by the BeatMaker: Music & Drum Pads Privacy Policy. The Software may use analytics, crash reporting, and subscription validation services as described there.
7. OWNERSHIP
All intellectual property rights in the Software and Sound Content belong to Licensor or its licensors. No rights are granted except the limited license in this EULA.
8. TERM AND TERMINATION
This EULA begins when you first download or use the Software and continues until terminated. It terminates automatically if you breach it. You may terminate by deleting the Software from your devices and cancelling any subscriptions with Apple. Upon termination, you must stop using the Software and delete all copies in your possession, except recordings of your performances you lawfully created, which you may keep subject to continuing restrictions on Sound Content.
9. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. LICENSOR’S TOTAL LIABILITY ARISING OUT OF THE SOFTWARE OR THIS EULA WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE OR RELATED SUBSCRIPTIONS THROUGH THE APP STORE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ZERO IF YOU ONLY USED FREE FEATURES).
11. EXPORT AND COMPLIANCE
You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with applicable export control and sanctions laws.
12. THIRD-PARTY BENEFICIARY (APPLE)
You and Licensor acknowledge that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary. Apple is not a party to this EULA and is not responsible for the Software or its content, except as required by Apple’s own terms.
13. GOVERNING LAW
This EULA is governed by applicable law as described in the Terms of Use, without prejudice to mandatory consumer protections in your country of residence.
14. ENTIRE AGREEMENT
This EULA, together with the Terms of Use and Privacy Policy, constitutes the entire license agreement between you and Licensor regarding the Software and supersedes prior license terms for the Software, except for mandatory Apple platform terms.
15. CONTACT
For EULA questions, contact the Publisher through the support options on the BeatMaker: Music & Drum Pads Apple App Store product page. No personal email address is listed in this document.
16. ACKNOWLEDGEMENT
BY USING BEATMAKER: MUSIC & DRUM PADS, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS EULA, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT.
