1. Agreement to Terms

By accessing or using Site RAMS at siterams.co.uk ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service. These terms constitute a legally binding agreement between you and Site RAMS.

2. Description of Service

Site RAMS is a cloud-based platform for creating and managing Risk Assessments and Method Statements (RAMS), incident reporting, hazard tracking, sign-offs, and related construction site safety documentation. The Service is designed to assist with health and safety compliance but does not replace professional health and safety advice.

3. Account Registration

When creating an account, you agree to:

• Provide accurate, current, and complete information.

• Maintain and update your information to keep it accurate.

• Keep your login credentials secure and confidential.

• Accept responsibility for all activity under your account.

• Notify us immediately of any unauthorised use of your account.

You must be at least 18 years old to create an account. One person or legal entity may not maintain more than one free account.

4. Organisations and Members

Organisation owners are responsible for managing their organisation's account, including member access and roles. Organisation owners may invite members and assign roles (owner, manager, supervisor, HSE, worker). You are responsible for ensuring that members of your organisation comply with these terms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.

• Upload or transmit viruses, malware, or any harmful code.

• Attempt to gain unauthorised access to the Service or its related systems.

• Interfere with or disrupt the integrity or performance of the Service.

• Use the Service to store or transmit infringing, defamatory, or otherwise unlawful material.

• Reverse engineer, decompile, or disassemble any part of the Service.

• Use automated systems to access the Service without our prior written consent.

6. Subscriptions and Billing

Certain features of the Service require a paid subscription. By subscribing:

• You authorise us to charge the applicable fees to your chosen payment method.

• Subscriptions renew automatically unless cancelled before the renewal date.

• Prices may change with 30 days' notice. Continued use constitutes acceptance of new prices.

• Refunds are handled on a case-by-case basis. Contact support@siterams.co.uk for refund requests.

A 14-day free trial is available for new organisations. No payment is required during the trial period.

7. Your Content

You retain ownership of all content you create using the Service, including RAMS documents, incident reports, hazard reports, and sign-offs. By using the Service, you grant us a limited licence to store, process, and display your content as necessary to provide the Service. We will not share your content with third parties except as described in our Privacy Policy.

8. Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by Site RAMS and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Site RAMS is a tool to assist with health and safety documentation — it does not constitute professional health and safety advice. You remain solely responsible for ensuring compliance with all applicable health and safety legislation.

10. Limitation of Liability

To the maximum extent permitted by law, Site RAMS and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Site RAMS from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us at support@siterams.co.uk. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
