Capacity assessments address whether there is an impairment or disturbance in the functioning of the mind or brain. A person lacks Capacity if they cannot demonstrate their ability within one or more of the following: understanding the relevant information, retaining that information long enough to make a decision, using or weighing the information as part of the decision-making process and/or communicating their decision (by any means). It is important to note that Capacity is topic specific.
We undertake Capacity assessments (within the meaning of the Mental Capacity Act 2005) with individuals who experience significant mental health or learning difficulties.
