Senate Bill 323 took effect January 1, 2020 and and modifies provisions governing HOA elections.
SB 323 prohibits members of the board, candidates for the board, individuals related to members of the board and anyone under contract with the association (such as the management company) from serving as the inspector of election.

It is recommended to consult the association's legal counsel. In my experience, certain avenues need to be travelled in order to come to a resolution. For example, many elections are uncontested and the HOA makes two attempts at a quorum. In this scenario, I've seen association members move forward by acclimation in which case AB Inspector of Elections will certify the election.
