Suspension or Administrative Leave
Suspension or Administrative Leave removes the trainee from program duties pending an investigation. This is to be used when continuing engagement with program duties poses a safety risk or when serious misconduct is identified. (ex. Fitness for duty, alleged harassment or assault). This may be imposed at the discretion of the Program Director, Department Chair, or Associate Dean for GME. Short-term paid administrative leave can be granted by the Associate Dean for GME during preliminary verification of the allegation(s).
This does become part of a trainee's permanent training record.
Goals
Removes the trainee from clinical service while concerns are investigated
Assures that the trainee is able to safely return to the program
Allows a period of time for the Program Director to evaluate next steps:
o Adjustments to the Individualized Learning Plan if appropriate (for academic deficiencies)
o Probation or Discipline Based on Misconduct
o Termination
Triggers
The learner cannot continue caring for patients safely
The learner is not capable of learning given the circumstances
The learner is a danger to herself/himself/themselves or others
The learner is greatly impeding the learning environment for other residents and students
The learner cannot continue to teach her/his/their peers and students if that is part of his/her/their role
The learner violated patient privacy rules, including but not limited to HIPAA regulations
The learner has unexcused absences beyond one day without reporting to the Program Director
The learner engages in conduct that is illegal, unethical, or in conflict with the University of Minnesota Graduate Medical Education or the site policies/compliance programs.
There is concern that the integrity of the investigation may be impacted by keeping the trainee on service.
Step by Step Process
Program Director consults immediately with the Associate Dean for GME.
Program Director gathers documentation and examples of the concerns; discusses only with those who need to know.
Program Director meets with the trainee to review and sign.
Program Director sets up a meeting at the end of the stated timeline to review.
Your Program Coordinator notifies the clinical sites and remove access to the electronic health records during the period of suspension.
