Section III. Dispute/ Disciplinary and Grievance Procedures

(Please refer to the Institution Policy Manual located on the GME website at http://z.umn.edu/gmeim for University of Minnesota Graduate Medical Education specific policies. Should policies in the Program Manual or Fellowship Addenda conflict with the Institution Manual, the Institution Manual takes precedence.)

GRIEVANCE/DISPUTE RESOLUTION

Disputes or conflicts that the resident/fellow has with any portion of the program should first be discussed with the program director. If the program director is unable to satisfactorily settle the issue, the department chair should become involved. Additionally, the Medical School has a Dispute Resolution Policy which provides for confidential and protected reporting and help resolving issues. The policy is available at:

If a grievance cannot be settled at the department level, the program leadership or trainee can appeal to the GME office as explained in “GME Policy: Discipline, Dismissal, Failure to Advance”.

- This protocol calls for notice before the action is taken, an opportunity for the resident to appear, and an appeals mechanism.

HARRASSMENT

The Department of Otolaryngology strongly supports the University’s position on issues related to harassment.

Special Issues Committee (Non-Academic)

This faculty committee considers serious non-academic infractions or charges made against a Department of Otolaryngology resident or fellow.

The committee is charged to:

Consider the issues in a fair and timely manner,

Maintain and preserve confidentiality, and

Hear all aspects of the infractions or charges made.

Membership is composed of the heads of the affiliated Departments of Otolaryngology (or designee) with a University faculty member selected by the head. The resident or fellow involved may select his/her advisor, or another faculty member, as a member with voting status.

After careful deliberation, the final decision and recommendation of the committee is made in a written report to the Program Director.

CONFIDENTIAL REPORTING

Concerns regarding unprofessional behavior, abuse, harassment, mistreatment, discrimination, or coercion that have not been adequately addressed by the program or Department can be confidentially reported at this link . The report form is reviewed outside of the department by the Surgical Administrative Center Education Manager.

Work Hours

Concerns about continuous work hour violations not adequately addressed by their program can be reported to the Designated Institutional Official at gme@umn.edu. Anonymous reporting of work hour violations can occur via a Qualtrics form. Trainees may also report violations directly to the ACGME.
