These Terms of Service ("Terms") constitute a legally binding agreement between you and TrustCheck AI operated by Troxo Pty Ltd ("we," "our," or "us") governing your access to and use of the TrustCheck AI application, website, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms on the Service, sending you an email notification, or providing an in-app notification, and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
If you do not agree to the modified terms, you should discontinue your use of the Service.
Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. By using the Service, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, which is incorporated by reference into these Terms.
You must be at least 13 years old (or the minimum legal age required in your country to use the Service) to use the Service. By using the Service, you represent and warrant that:
• You are at least 13 years old (or the minimum legal age in your jurisdiction) • You have the legal capacity to enter into these Terms • You are not barred from using the Service under applicable law • You will comply with these Terms and all applicable laws and regulations
If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" will refer to that entity.
To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for:
• Safeguarding your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account or any other breach of security
We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms or if we suspect unauthorized or fraudulent use of your account.
Our Service operates on a freemium model with usage limitations designed to ensure fair access for all users and compliance with mobile app store requirements.
Each device is entitled to 4 free scans of our scam detection service. These free scans are provided on a per-device basis and are not transferable between devices. Once you have used your 4 free scans, you will need to subscribe to continue using the Service.
Our premium subscription provides access to 300 scans per monthly billing cycle for $3.99 USD per month (or equivalent in local currency). Premium subscribers also gain access to additional features and priority support.
Subscription features include:
• 300 scans per monthly billing cycle
• Access to all scan types (text, image, URL, deepfake detection)
• Scan history and reporting
• Premium features and updates
For subscriptions purchased through supported app stores:
• Payment will be charged to your app store account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions through your device's app store subscription settings
• These Terms are between you and TrustCheck AI, not the app store platform
• The app store platform is not responsible for the Service or its content
• The app store platform has no warranty obligations with respect to the Service
All payments are processed through third-party payment processors, including mobile app store platforms. We do not store your payment information. Your use of these payment services is subject to their respective terms and conditions.
We reserve the right to change our subscription fees at any time. If we change our fees, we will provide notice of the change on the Service or by email at least 30 days before the change takes effect. Your continued use of the Service after the fee change becomes effective constitutes your agreement to pay the updated fee amount.
Our usage limits are designed to ensure fair access to our Service for all users. Scan limits reset at the beginning of each monthly billing cycle for premium subscribers. Attempts to circumvent usage limits, including but not limited to creating multiple accounts or using multiple devices to exceed free scan allocations, may result in account suspension or termination.
You may cancel your subscription at any time through your device's app store subscription settings or by contacting our customer support team.
When you cancel:
• Your subscription will remain active until the end of your current billing period
• You will not be charged for the next billing period
• No partial refunds are provided for unused portions of the current billing period
• You will continue to have access to premium features until the end of your current billing period
After cancellation, your account will revert to the free version with limited features when your current subscription period ends.
For purchases made through mobile app stores, refunds are handled by the respective app store platform according to their refund policies. Please contact your app store platform directly for refund requests for purchases made through their systems.
We offer direct refunds only in the following circumstances:
• The Service is completely non-functional and we are unable to resolve the issue within a reasonable timeframe • You were charged multiple times for the same subscription period
• Technical errors in our billing system
To request a refund from us directly, please contact our customer support team with details of your issue. Refund requests must be submitted within 14 days of the charge date.
The Service allows you to submit content for analysis, such as text messages, links, and images ("User Content"). You retain all rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving the Service.
You represent and warrant that:
• You own or have the necessary rights to submit your User Content
• Your User Content does not violate the rights of any third party or any applicable law
• Your User Content does not contain any material that is defamatory, obscene, unlawful, threatening, abusive, or otherwise objectionable
• Your User Content does not contain any viruses, malware, or other harmful code
Our Service strictly prohibits the submission, sharing, or analysis of the following types of content in accordance with mobile app store policies: • Nudity or sexually explicit content
• Graphic violence or gore
• Child exploitation or abuse
• Illegal activities or content that promotes illegal activities
• Extreme hate speech or incitement to violence
• Content that violates mobile app store review guidelines
• Content that violates app store developer program policies
We employ automated content moderation systems to detect and block prohibited content. If you attempt to submit content that violates this policy, your submission may be blocked and your account may be subject to suspension or termination.
If you download the Service from a mobile app store:
• These Terms are between you and TrustCheck AI, not the app store platform
• The app store platform is not responsible for the Service or its content
• The app store platform has no warranty obligations with respect to the Service
• The app store platform is not responsible for addressing any claims relating to the Service
• Your app store platform's terms of service also apply to your use of the Service
• You must comply with applicable app store developer program policies
You agree not to:
• Use the Service for any illegal purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Circumvent any technological measures implemented to protect the Service
• Use the Service to transmit malware, viruses, or other harmful code
• Engage in any activity that could disable, overburden, or impair the Service
• Use any robot, spider, crawler, scraper, or other automated means to access the Service
• Attempt to circumvent usage limits through multiple accounts, devices, or other means • Violate mobile app store review guidelines or developer program policies
The Service and its content, features, and functionality are owned by TrustCheck AI and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WHILE WE STRIVE TO PROVIDE ACCURATE ANALYSIS OF TEXT MESSAGES, IMAGES, SCREENSHOTS, WEBSITE LINKS, DEEPFAKE DETECTION, AND OTHER DIGITAL CONTENT, WE CANNOT GUARANTEE THAT ALL SCAMS, PHISHING ATTEMPTS, MALICIOUS LINKS, AI-GENERATED IMAGES, OR OTHER FRAUDULENT CONTENT WILL BE DETECTED OR THAT ALL LEGITIMATE CONTENT WILL BE CORRECTLY IDENTIFIED AS SAFE OR AS A SCAM. THE SERVICE IS INTENDED AS A TOOL TO ASSIST YOU IN EVALUATING DIGITAL CONTENT, BUT YOU SHOULD ALWAYS EXERCISE YOUR OWN JUDGMENT AND VERIFY INFORMATION INDEPENDENTLY BEFORE TAKING ANY ACTION BASED ON OUR ANALYSIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRUSTCHECK AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to its conflict of law provisions.
