Attend a forum to learn about the Colorado HOA Information and Resource Center. You will have the opportunity to voice your questions and concerns regarding HOAs. At the forum, helpful resources will be provided along with a discussion of the rights and obligations of living in an HOA community. Topics and locations change monthly.
Historically, the Colorado Legislature, Governor’s Office and Colorado Municipalities have proclaimed October as the month of the year to recognize that there are methods and processes that can be used in facilitating the peaceful ending of conflict and retribution. Our Spotlight this month focuses on how conflict resolution can be used in the context of living in an HOA.
We have two articles that can help homeowners deal with issues and conflicts in their HOA: Conflict Resolution Tips for De-Escalation, and Understanding Conflict Resolution Mediation. In addition, we have an educational video on Handling Disputes in HOAs that will assist HOA board members in helping to resolve conflicts between homeowners and the HOA.
Psychologically Impacted Property - Within the past week, we have seen a spike in the number of inquiries and complaints about properties that have been the scene of a crime, or are perceived to be crime scenes. We have been fielding questions about what real estate brokers should or should not be disclosing, and in some instances, what an appraiser can share with someone who is neither the client nor the intended user of an appraisal.
Colorado Real Estate Commissions’ Subdivision Rule Review - The Division, on behalf of the Colorado Real Estate Commission, is currently conducting a review of the administrative rules for subdivisions and timeshares. The review will assess the continuing need for, the appropriateness, and cost-effectiveness of the regulations. This assessment will also determine if they should be continued in their current form, modified, or repealed.
New and Updated Commission Contracts and Forms for Use in 2021 - The Division of Real Estate and the Colorado Real Estate Commission, working in conjunction with the Forms Committee, have adopted and finalized the 2021 mandatory contracts and forms.
Board of Mortgage Loan Originator Rules, Effective January 1, 2021
On July 15, 2020 the Colorado Board of Mortgage Loan Originators (“Board”) held a rule-making hearing to update and adopt rules for mortgage loan originators and mortgage companies based upon the mandatory rule review required by Senate Bill 14-063 (Mandatory Review of State Agency Rules). The Division of Real Estate (“Division”) initiated the rule review on behalf of the Board to assess the continuing need for, appropriateness and cost effectiveness of the administrative rules. It also assessed whether the rules should be continued in their current form, amended or repealed.
HUD Guidance on Assessing a Person’s Request to Have an Animal as a Reasonable Accommodation Under the Fair Housing Act A Real Estate Advisory
Earlier this year, the U.S. Department of Housing and Urban Development (HUD) provided new guidelines to help explain certain obligations of housing providers under the Fair Housing Act (FHA) with respect to animals that individuals with disabilities may request as reasonable accommodations. While this issue has caused much confusion for landlords and property managers, these guidelines will assist in creating a set of best practices for complying with the FHA when making these assessments and to avoid violations.

Reverse Mortgages in the COVID Era - These uncertain times have prompted many of us to reevaluate much about our daily lives. Among other matters, this includes where we live, how we shop, and for many, how we work. When change is forced upon us it is unsettling. Still, we also know that change presents opportunities. Understanding Appraisal Scope of Work Requirements - The Division of Real Estate (Division) is pleased to continue with its series of advisories for real estate appraisers designed to achieve better compliance with the Colorado Real Estate Appraiser Licensing Act, the Board Rules and the Uniform Standards of Professional Appraisal Practice (USPAP). The series of advisories have been developed from the Division’s review of work products from investigation and licensure applications. The advisories are designed to provide a quick and easy to follow format that addresses the most common appraisal issues seen by the Division. In this second installment of a four-part advisory series, licensees will learn how to be compliant with the “Scope of Work Rule.” and common issues encountered when developing assignment results.
