ENFORCEMENT
OF THE
DECLARATION OF COVENANTS AND RESTRICTIONS,
BYLAWS, RULES AND REGULATIONS
FOR
THE PLAT OF WILLOWS CROSSING
WHEREAS, the Declaration of Covenants and Restrictions for the Plat of Willows Crossing, a development in Thurston County, Washington, was amended and recorded on June 10, 2004, under Thurston County Auditor’s file number 3648436; and
WHEREAS, the Declaration provides in Article VIII, Section 3, that the Board of Directors shall have the power to enforce the provisions of the Declaration, Bylaws, Rules and Regulations of the Association for the benefit of the Association; now
THEREFORE, the Board of Directors adopts an Enforcement Procedure as follows:
1. WRITTEN COMPLAINT – The Association Manager must receive a complaint, in writing, stating the following (a) the nature of the violation (b) the specific rule, regulation, or CC&R section in violation (c) the address of the homeowner in violation, (d) the name, address, and phone number of the Complainant and (e) specify if immediate action is needed, otherwise it will be addressed at the next board meeting.
2. BOARD ACTION TO ADDRESS COMPLAINT – The Association Manager will forward the complaint onto the Board for further action. If found to be in violation, the Board will request that the Association Manager send a violation letter to the homeowner in violation. The violation letter shall state the following (a) the nature of the violation (b) the specific rule, regulation, or CC&R section in violation (c) the amount of time in which the violation must be corrected, and (d) the possible monetary fine if the violation is not corrected.
3. If the Board determines that the homeowner is not in violation, a letter will be sent in response to the complainant stating the findings of the Board.
