Our Chartered Surveyor had advised us that, as there is no mention of windows in the lease, the responsibility for repairing windows in the flats is that of the leaseholders of the respective flats. Therefore, the management company should not pay for or reimburse the lessees for repairs to the windows of their flats. At the AGM on 7 September 2009, it was decided to accept the Chartered Surveyor's advice. It was also noted that the directors may be held personally liable for reimbursement if they paid for expenses which could be challenged successfully at the tribunal by another leaseholder as being payments that are not required to be made in accordance with the terms of the lease.
If you replace your windows, please ensure that the replacement looks identical to the existing windows.Â
