Marriage License
REQUIREMENTS FOR OBTAINING A MARRIAGE LICENSE
You must:
1. Be of sound mind;
2. Be at least 18 years of age;
3. Have valid divorce documents if previously married;
4. Have proper identification – Acceptable forms of identification include, Driver’s License, State I.D. Card, Passport, Armed Forces I.D. Card, Resident Alien I.D. Card, or Birth Certificate;
The State of Georgia no longer requires a Blood Test for a Marriage License.
RESIDENCY REQUIREMENTS:
1. One party is a resident of Georgia, License can be issued in any county in Georgia.
2. Non-resident of Georgia, License must be issued in the county the ceremony is performed.
Age Requirements:
The parties must be of sound mind, must have no living spouse from an un-dissolved prior marriage, and must not be related in a degree prohibited by law. Both parties must be at least 18 years of age. A 17 year old may be issued a marriage license only IF ALL OF THE FOLLOWING ARE MET:
A. A PETITION IS GRANTED IN JUVENILE COURT FOR EMANCIPATION AND A CERTIFIED COPY OF SUCH ORDER IS PRESENTED. (SEE §15-11-720)
B. 15 DAYS HAVE PASSED SINCE THE DATE THE ORDER GRANTING EMANCIPATION WAS GRANTED.
C. THE OLDER PARTY TO THE MARRIAGE IS NO MORE THAN 4 YEARS OLDER THAN THE YOUNGER PARTY.
D. APPLICANTS HAVE COMPLETED PREMARITAL EDUCATION ACCORDING TO §19-3-30.1 (THERE ARE ADDITIONAL COUNSELING REQUIREMENTS FOR THOSE 17 YEARS OLD)
As of July 1, 2019, No one under the age of 17 shall be issued a marriage license in the State of Georgia. Parental consent to a marriage license is no longer allowed in this State.
PREVIOUS MARRIAGE:
If a person has been married before and the marriage ended with the death of a spouse, we require a death certificate.
If the marriage ended with divorce, we must see a copy of the final judgment and decree signed by the Judge.
PAYMENT:
The cost of the marriage license is $80.00.
If the couple presents the “Certification of Completion of Qualifying Premarital Education” to the court at the time the license is issued, the cost will be $40.00.
