Welcome to the Grande Cay Community at Gulf Harbour Golf and Country Club!

Our community consists of 114 condominiums with golf course, pond, and pool views. Grande Cay is a condominium community which, by definition, does not allow for the same degree of individual expression you may have been accustomed to in your previous home or neighborhood.It is important that you Read and Understand these Rules and Regulations.


As members of a condominium community, we are responsible not only for our personal property, but for the property and equipment of the community. Rules and Regulations may be amended at any time by a majority vote of the association’s Board of Directors.


The Rules and Regulations include, but not limited to the following, Safety, Unit Maintenance/Water Safety, Renovations, Parking, Decorations, Pets, Display of Flags, Leasing of Units, Considerations of Others, an Landscaping

Violating any of these Rules and Regulations may result in a fine.

GRANDE CAY

RULES & REGULATIONS


Safety

1. The walkways and entries should not be obstructed nor used for any purpose other than for ingress and egress to and from the Condominium (fire code).

2. No Unit Owner shall use or permit to be brought into the living areas of any home any flammable oils or fluids, such as gasoline, kerosene, naphtha benzene, propane/butane, or other explosives or articles deemed extra hazardous to life, limb, or property. Use of fuel-driven (e.g., propane or charcoal) barbecues are prohibited on the lanai, porch, or in the garage. All grills must stored inside the garage when not in use.

3. All garage doors shall remain closed when not in use to keep out palm rats, rabbits, lizards, snakes, etc. An open, unattended garage door is also an invitation to unwanted visitors. Keep your garage doors closed for the safety and security of your home.

4. It is recommended for owners to keep the gate to their courtyards closed.

Renovations

1. Owners must submit proper Architectural Specifications and provide appropriate documentation before changes such as, but not limited to, AC modifications, window replacement, lanai enclosures, entry doors, floors, etc. Owners should review the appropriate forms and specifications on the Grande Cay/Suitor login website, under “Forms”. https://smca.cincwebaxis.com/

2. All indoor window treatments seen from the outside must be white or off-white. Any deviations must be approved by the Association prior to installation.

Decorations

  1. The exterior of a home, including gates, gutters, roofs, and fences, shall not be painted, decorated, or modified by any Unit Owner in any manner. The only exception being that reasonable holiday decorations are permitted. Lights and/or decorations may not be strung across any walkway. All holiday decorations must be removed one week after the holiday.

  1. No article shall be hung from the doors (with exception of well-maintained wreaths), railings, windows, or screened lanais of a home, or placed upon the outside windowsills of a home.

  1. No articles shall be allowed to stand on or placed in any portion of the common areas (which includes grass areas around all of Grande Cay).


Display of Flags

A Unit Owner may only display the United States of America flag outside their Unit so long as the display conforms to the following regulations:

. Flags must be flown in a respectful manner and properly illuminated if flown 24 hours a day.

. Flags may be no larger than 3 feet by 5 feet and maintained in good condition.

. Flag mount and placement to be approved by the Association.

Considerations of Others

1. No Unit Owner, family member, guest or lessee shall make or permit any noises that will disturb or annoy or interfere with the rights, comfort, enjoyment, or convenience of other Unit Owners. (Refer to Master Association Rules and Regulations for acceptable noise levels.)

2. Each Unit Owner shall keep the exterior of their home in a state of preservation and cleanliness.

3. Each Unit Owner shall be held responsible for the actions of their family members, guests, invitees, and lessees. Any damage to the Association property or equipment of the Association caused by any Unit Owner, family member, guest, or lessee shall be repaired or replaced at the expense of the Unit Owner.

4. If a unit owner engages any employee or agent (vendor) of the association to perform personal work for the unit owner, such work must be separately contracted between the owner and vendor. Owner assumes all liability for such contracted work.

Unit Access

1. Each Unit Owner who will be absent from their home during the hurricane season must prepare their home prior to their departure by:

a. removing all furniture, potted plants, and other movable objects from their courtyard, porch, and lanai; and

b. designating a responsible individual to inspect their home should the home suffer hurricane damage.


2. Each Unit Owner is required to provide a unit key or unit access code to the Management Company and/or house watch to allow access in the event of an emergency. If a Unit Owner alters the lock or installs a new lock or keypad on their entry door, the Unit Owner will provide the Management Company with a replacement key or entry keypad code. If emergency access is required and the Unit Owner / house watch has not responded in a timely manner and the Management Company does not have a key (or access code), a locksmith will be hired at owner’s expense to provide entry.

3. Owners must allow agents and employees of the Association and contractors, or workers authorized by the Association to enter any unit at any reasonable hour of the day for association-funded safety and maintenance purposes. Entry will be prearranged with the Unit Owner.

  1. Under circumstances deemed an emergency by the Association or its Management agent, access is permitted regardless of the hour.

Trash Removal

All garbage, trash, refuse or rubbish must be placed IN appropriate trash facilities. All trash or garbage containers shall be stored inside a home or garage.

1. NO ITEMS SHALL BE LEFT OUTSIDE OF THE DUMPSTER OR RECYCLING CONTAINERS OR ON THE GROUND. WASTE DISPOSAL COMPANY WILL NOT PICK UP THESE ITEMS.

2. Removal of large items such as furniture, mattresses, and appliances is the responsibility of the unit owner. Suggested removal companies are listed on dumpster gate.

3. Do not dispose of construction materials in the dumpster. Unit owner’s contractor should haul them away or unit owner should make arrangements for their removal. Suggested removal companies are listed on dumpster gate.

4. There are three dumpsters in Grande Cay. If one is full, use another.

5. Boxes must be broken down before placing in dumpster or recycle bins.

6. Recycle bins are for recyclable materials only, not trash or dog droppings.

Unit Maintenance/Water Safety

  1.   1. Unit owners/renters who will be away from their units for more than 72 hours must turn off the water at their unit’s main shut off valve. Hot water heaters must be powered down from the breaker box when water is shut off. The shut off valves are outside the unit at the hose junction.

3. Hot water heaters should be maintained in proper working order to prevent potential water damage. Refer to Hot Water Heater Guidelines on website for details. https://smca.cincwebaxis.com/


4. Original plastic refrigerator water lines should be replaced with a copper, shielded flexible line, or similar water line and shut off. The original plastic water lines become brittle over time, split and leak, potentially causing water damage.

5. Original washing machine hoses should be replaced with heavy duty, code-compliant, metal-mesh water hoses. The original rubber water lines become brittle over time, split and leak, potentially causing water damage.

6. Original toilet hoses should be replaced with heavy duty, code-compliant, metal-mesh water hoses. The original rubber water lines become brittle over time, split and leak, potentially causing water damage.

Parking

1. No parking is allowed on the street at any time. Parking is only allowed in driveways and paved parking areas. Contractors may park on street during business hours.

2. In season, January 1 thru April 30, residents (owners, renters, lessees) must park all personal vehicles in their garage or driveway.

3. Within the Community, unit owners with a two-car garage are limited to no more than four vehicles. Unit owners with a one car garage are limited to no more than two vehicles.

  1. No vehicle will be allowed to be left unattended or abandoned for longer than two weeks in the community spaces. If not moved after proper notice, the vehicle may be towed at the owner’s expense and the owner may be subject to a fine.

5. Vehicles with commercial markings shall be kept within an enclosed garage. Any motor vehicle the exterior of which is not maintained in accordance with manufacturer specifications and/or is allowed to unreasonably deteriorate may be towed at the vehicle owner’s expense. Written notice of the violation will first be delivered to said vehicle owner or posted on the vehicle.

6. No commercial vendor vehicle of any kind shall be permitted to be parked for more than twelve (12) hours unless it is being used in the actual construction or repair of a structure or for grounds maintenance.

Pets

1. The total number of domesticated pets allowed in any unit at one time shall not exceed two. All pets must be leashed at all times. All pets must be registered with Management Company and must be licensed and vaccinated in accordance with Lee County regulations. However, under no circumstances will a Pit Bull, or any poisonous or other dangerous animals or insects, as determined by the Board, be brought to, or caused to be brought to or kept on any Association property.

2. A unit owner shall immediately pick up, remove, and properly dispose of any solid animal waste deposited by his/her pet. A pet or any animal under the control of a unit owner may not be kept or stored or housed on any outside area or patio or lanai.

Leasing of Units

No unit may be leased more than five (5) times in a year, with a minimum lease term being one month and a maximum term being one year at a time. All rentals or leases of units must be submitted in writing to the Management Company at least 10 days prior to occupancy. Landscaping

1. All landscaping in the courtyards must follow landscaping guidelines. If not properly maintained, the Association reserves the right to make necessary modifications.

2. The courtyards are considered a limited common element for use the unit owner. If Unit Owner does not maintain the courtyard area in keeping with the overall esthetics of the community, the Association will, at its discretion, have a professional landscaper perform appropriate maintenance/removal.

3. Maintenance of any potted plants is the responsibility of the homeowner. The landscaping company will not trim, fertilize or maintain them. Plants that are not healthy and thriving will be removed at the discretion of the professional landscape company.

4. No personal décor items, including but not limited to, solar lights, garden flags, signs, statuary, bird feeders, whirligigs, chairs, or artificial flowers/plants are allowed outside the courtyards or behind the units. The exception being reasonable holiday decorations which must be removed one week after the holiday.
