Liability Waiver for attending or participating in any 

AgrawalsOfWashington program

I recognize that AgrawalsofWashington (Nonprofit Organization) relies on volunteers and community participation, and does not have any liability insurance nor any ability whatsoever to meet any liability or other claims. Utilizing waiver forms in your Nonprofit Organization is essential eliminating exposure to lawsuits, incidents, and claims. 

Acknowledgement of Risk or Injury Possibility

As a participant or volunteer in the program, I recognize the risk and acknowledge that there are certain risks of physical injury, including death, damages, property damage, or loss which I may sustain as a result of participating in any and all activities connected with such program, or the use of the facilities or equipment.

Waiver of Claim for Injury

I agree to waive and relinquish all claims that I (including any family member or dependent I represent) may have for injuries or damages, as a result of participating in the program or using the facilities or equipment against Nonprofit Organization and its officers, agents, servants, employees, other volunteers, and affiliates.  

Release and Indemnity from Liability

I do hereby release and discharge and agree to indemnify and hold harmless Nonprofit Organization and its officers, agents, servants, employees, volunteers and affiliates from any and all claims for injuries (including death), damages, property damage, or loss which may have or may in future accrue to me or anyone else on account of or connected with my participating in or volunteering for the Nonprofit Organization.

Photo consent

By purchasing these tickets, you confirm and consent that AoW may hire a professional photographer to take pictures of the event and process the images within their standard handling and portfolio policies. You also consent that AoW may use these photographs on our web site and social media for non-commercial purposes. 

Release and Waiver of Liability 

We/I understand that participation in this event, including activities leading up to or out of these events, and use of other King County facilities / Washington state parks / Lake Washington School District pose certain risks and dangers, including, but not limited to, slips, trips, falls, athletic injuries, illness (including exposure to and infection with viruses or bacteria), unforeseen events caused by the forces of nature, property damage, personal and/or bodily injury, paralysis, death, or other harmful consequences to any person, family member or participant. We/I acknowledge that the preceding list is not inclusive of all possible risks associated with participation in this event or use of associated facilities and that said list in no way limits the operation of this Agreement. 

In consideration of the undersigned organization’s or individual’s opportunity to use these facilities, the undersigned organization or individual hereby agrees to assume all risks for any harm, property loss or damage, personal and/or bodily injury, paralysis, death, or other harmful consequences that may occur to the undersigned organization or individual and/or its registrants/persons and participants in connection with the use of the facilities, regardless of whether such risks, harm, injury, or damage were foreseen or unforeseen. The undersigned organization or individual understands that neither the Agrawals of Washington organization, nor its Directors or volunteers or agents, nor King County or Lake Washington School District shall be held liable in any way for any occurrence arising out of the organization’s or individual’s use of these facilities and agrees to waive any right of recovery. The undersigned organization or individual also agrees to protect, defend, indemnify, and save harmless Agrawals of Washington, King County and  / Lake Washington School District, its officers, officials, employees, volunteers and agents, from any and all claims, demands, suits, penalties, losses, damages, judgments, or costs of any kind whatsoever, arising out of or in any way resulting from the participation in this event or use of associated facilities. In the event Agrawals of Washington, King County or Lake Washington School District incurs any judgement, award and/or cost arising from the organization’s or individual’s use of these facilities, including attorney fees, all such fees, expenses, and costs shall be recoverable from the undersigned organization or individual. 

Coronavirus / COVID-19 Warning & Disclaimer Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participation in this event, including Use of King County facilities / Washington state parks  / Lake Washington School District, could increase the risk of contracting COVID-19. None of the Agrawals of Washington, King County or Lake Washington School District in any way warrant that COVID-19 infection will not occur through said participation or use. The undersigned acknowledges the highly contagious nature of Covid-19 and voluntarily assumes the risk that the undersigned individual, organization, and/or its registrants/ person and participants may be exposed to or infected by COVID-19 by said participation or use and that such exposure or infection may result in personal injury, illness, permanent disability, and death. The undersigned understands that the risk of becoming exposed to or infected by COVID-19 in this event or at a King County facility, Washington state park or  Lake Washington School District may result from the actions, omissions, or negligence of the undersigned individual, organization, its registrants, volunteers and participants, and others, including, but not limited to, Agrawals of Washington Directors, agents and volunteers, King County employees, volunteers, and other participants and their families. 

I HAVE READ THE ABOVE TERMS AND CONDITIONS, INCLUDING THE WAIVER OF ALL LIABILITY.
IT IS ONLY ON THIS BASIS THAT I AM PROCEEDING TO ATTEND ANY EVENT
and/or PURCHASE TICKETS FOR THIS EVENT.
