Client Rights
Please review your rights and responsibilities. It is important that you know your rights, so you can protect yourself from any misconducts and aware of elderly abuse. Knowing your responsibilities is also essential to the delivery of care service provide to you. By complying with the provider and mandates, care service can be delivered effectively.
Client Rights
to be fully informed of all client’s rights and all of Agency’s rules governing client’s responsibilities;
to be fully informed of the services Agency is providing;
to be informed of any changes in services and charges as they occur;
to participate in the planning of services, including referral to a health care institution or other provider and to refuse to participate in experimental research;
to have access to information about the client’s health condition to the extend required by law;
to refuse service and to be informed of the consequences of that refusal;
to confidential treatment of personal and medical records and to approve or refuse their release to any individual outside the provider, except in the case of transfer to another provider or health facility, or as otherwise permitted by law;
to be treated with consideration, respect and full recognition of dignity and individuality, including privacy in treatment and in care for personal needs;
to be taught the service required so that the client can, to the extent possible, help himself or herself;
to have a person designated by the client taught the service required, so that, to the extent possible, the person designated can understand and help the client;
to have one’s property treated with respect;
to complain about the care that was provided or not provided, and to seek resolution of the complaint without fear of recrimination;
to have the client’s family or legal representative exercise the client’s rights when the legal representative is legally authorized to do so;
be cared for by qualified, competent and trained personnel;
be spoken to or communicated with in a manner or language they can understand;
to receive service and be dealt with without regard to race, color, age, sex, sexual orientation, creed, religion, disability and familial/cultural factors; and
participate in the development of a plan for their care.
Client Responsibilities
providing complete information about matters relating to their health and abilities when it could influence the care they are being given;
reporting any potential risks that might exist to the Personal Care Attendant such as the possibility that a client/family member might have a contagious illness or condition;
reporting unexpected changes in their condition, such as having suffered a mild stroke;
requesting information about anything that they do not understand;
contacting the office with any concerns or problems regarding services;
following service plans and/or expressing any concerns they have about the Care Plan;
accepting the consequences, if the Care Plan is not followed;
following the terms and conditions of the Service Agreement;
notifying the Agency, in advance, of any changes to the work schedule;
notifying the Agency of any advanced directives they sign. e.g. a Do Not Resuscitate order;
being considerate of property/equipment belonging to the Agency and/or Personal Care Attendant;
notifying Agency of any changes being made to their contact information such as address or phone number;
advising Agency of any changes being made to their Health Care Professionals. e.g. Physician, Physiotherapist, Occupational Therapist, Dietician, Registered Nurse, etc.
advising the Agency if they are not satisfied with the care or services being delivered;
paying bills according to agreed upon rates and time frames;
assume financial responsibility for all materials, supplies and equipment required for their care;
providing a safe environment for care and services to be delivered;
giving reasonable notice, when possible, if service is going to be cancelled;
keeping all weapons in the home away from the work area during visits made by the Personal Care Attendant;
securing aggressive or menacing pets before the Personal Care Attendant enters the home;
providing a smoke free environment when Personal Care Attendant is present;
reviewing and signing the PCA time sheet, upon completion of shift;
treating Personal Care Attendant in a courteous and respectful manner, and,
ensuring that Personal Care Attendants are free from any actions that could be deemed to be abusive such as intimidation, physical/ sexual/ verbal/ mental/ emotional/material/ financial abuse, etc.
