What is Preemption?
Preemptive state tobacco control legislation prohibits local governments from enacting tobacco control laws that are more stringent than state law. In Tennessee that means local city and county governments cannot control where smoking and vaping is allowed on their own property. Any park, playground, splash pad, or other place children like to play, but are owned by the city or county, cannot protect our children from secondhand smoke exposure.
The Coalition's Advocacy Committee has considered the public policy of preemption repeal and evaluated the issue. Below is the document the committee worked through to study and discuss the issue and reported back to the coalition as a recommendation.
