For works created after 1978, copyright protection exists for the life of the autor plus 70 years
Registration with the Copyright Office is not necessary, but it is required prior to bringing an infringement suit.

What is a derivative work? A work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgement, condensation, or any other form in which a work may be recast, transformed or adapted.
A digital media work that combines media and information from preexisting sources to create a new derivative work
It may contain text, audio, video or other derivative work
