How do I go about being removed from the PC 290 registration obligation?

Adults

Effective July 1, 2021, people with adult convictions for specified sex crimes may petition for removal from the sex registry after being on the registry for at least 10 or 20 years, depending on the crime. The respective time provisions are as follows:

Tier 1

10 Years

PC 243.4 (misdemeanor only) PC 243.4(b) (misdemeanor or felony)

PC 288a(b), (e), (j), (k) PC 289(c), (f), (g), (h), (i)

PC 266 PC 311.1 (misdemeanor only)

PC 266c PC 311.11 (misdemeanor only)

PC 286(b),(e),(j),(k) PC 314(1), (2)

PC 287(b), (e), (j), (k) PC 647.6 (1st Conviction)

All discretionary registration under PC 290.006

Tier 2

20 Years

PC 261(a)(1), (a)(5), (a)(6), (a)(7) PC 288(a)

PC 285 PC 288a(c)(1), (c)(3),(g), (h)**

Tier 3

Lifetime

All adult sex convictions not listed above are still subject to lifetime sex registration.

Note that for adult sex registration, subsequent convictions, and specifically convictions for failing to register under PC 290, will extend the period you have to wait before petitioning for removal from the sex registry. You must have proof of current registration. You may petition in Ventura County as long as you are registered in Ventura County even if your conviction was out of the county. You must be out of custody and off all forms of supervision (probation, parole, etc.) when you petition for removal from the sex registry.

In order to petition for removal, you must:

• Continue to register!

• Retain proof of your current registration.

• Request a tier designation letter from your local registering law enforcement agency.

• Be out of custody and off of supervision.

• File a petition for removal in the month of your birth JULY 2021 TO JUNE 2022.

Juveniles

Juvenile adjudications are no longer subject to lifetime registration. Effective July 1, 2021, people with juvenile adjudications for specific sex crimes may petition for removal from the sex registry after being on the registry for at least 5 or 10 years, depending on the crime. The respective time provisions are:
