Welcome to “Connect Medsolu Locally”. Medsolu (OPC) Private Limited (“us”, “we”, or “Medsolu”, which also includes its affiliates) is the owner of the mobile application ‘Connect Medsolu locally’, (referred to as the “Services”).

We value the trust you place in us. That's why we insist upon the highest standards for secure transactions and customer information privacy. Please read the following statement to learn about our information gathering and dissemination practices.

This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose and protect Personal information about the Users of our services through our mobile application. We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use.

General Terms:

1.      By accessing or using the Mobile application, or by otherwise giving Us Your information, You confirm that You have the capacity to enter into a legally binding contract under Indian law, in particular, the Indian Contract Act, 1872, and have read, understood and agreed to the practices and policies outlined in this Privacy Policy and agree to be bound by the Privacy Policy.

 

2.      You hereby consent to our collection, use, sharing, and disclosure of your information as described in this Privacy Policy. We reserve the right to change, modify, add or delete portions of the terms of this Privacy Policy, at our sole discretion, at any time, and any continued use of the App, the Services or the Platform, following any such amendments to the Privacy Policy, will be deemed as an implicit acceptance of the Privacy Policy in its amended form. You are requested to review the Privacy Policy from time to time to keep yourself updated with any changes, modifications made to the terms hereof.

 

3.      If You are accessing or using Services on the App from an overseas location, You do so at your own risk, and shall be solely liable for compliance with any applicable local laws.

 

4.      By using our services or by otherwise giving us information, you will be deemed to have read, understood and agreed to the practices and policies outlined in this privacy policy and agree to be bound by the Privacy Policy. If You do not agree with any of the terms and conditions of this Privacy Policy at any time, please do not proceed further to use this App or any Services or give us any of your information.

 

Collection of Personally Identifiable Information and other Information

 

When you use or access the services, we collect and store your personal information which is provided by you from time to time. Our primary goal in doing so is to provide you a safe, efficient, smooth, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our mobile application to make your experience safer and easier. More importantly, while doing so we collect personal information from you that we consider necessary for achieving this purpose.

 

You hereby consent to the collection of such information by Medsolu. Without prejudice to the generality of the above, information collected by us from you may include (but is not limited to) the following:

i.      contact data (such as your email address and phone number);

ii.     demographic data (such as your gender, your date of birth and your pin code);

iii.    data regarding your usage of the services;

iv.     other information that you voluntarily choose to provide to us (such as information shared by you with us through emails or letters) including any images and other documents/files.

 

The information collected from you by Medsolu may constitute ‘personal information’ or ‘sensitive personal data or information’ under the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. (SPDI Rules,2011.)

 

In general, you can browse the mobile application without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to use a particular service or feature on the mobile application. We may automatically track certain information about you based upon your behaviour on our mobile application. We use this information to do internal research on our users' demographics, interests, and behaviour to better understand, protect and serve our users. This information is compiled and analysed on an aggregated basis.

 

We use data collection devices such as "cookies" on the mobile application to help analyse our mobile application flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of a "cookie". We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Most cookies are "session cookies," meaning that they are automatically deleted at the end of a session. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the mobile application and you may be required to re-enter your password more frequently during a session.

 

Additionally, you may encounter "cookies" or other similar devices on certain pages of the mobile application that are placed by third parties. We do not control the use of cookies by third parties.

 

If you choose to buy on the mobile application, we collect information about your buying behaviour.

 

If you transact with us, we collect some additional information, such as a billing address and/ or other payment instrument details and tracking information of your payment.

 

If you choose to post messages on our message boards, chat rooms or other message areas or leave feedback, we will collect that information you provide to us. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.

 

If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the General Terms, we may collect such information into a file specific to you.

 

We collect personally identifiable information (email address, name, phone number, credit card / debit card / other payment instrument details, etc.) from you when you set up a free account with us. While you can browse some sections of our General Terms: without being a registered member, certain activities (such as placing an order) do require registration. We do use your contact information to send you offers based on your previous orders and your interests.

 

Medsolu will be free to use, collect and disclose information that is freely available in the public domain without your consent.

 

Information You Give Us: 

 

We receive and store any information You enter on Our Platform or provide us in any other way. When You register on the App, We collect registration details such as phone number, name, geographical address and email address. We verify Your phone number with the help of a one-time password sent to Your phone number.

 

We may also collect information required for providing You Services on the Platform including, items you place in the cart, pharmaceutical, nutraceutical products including prescription drugs or over the counter (OTC) products You may order, facilitating booking a consultation with a Medical Practitioner, scheduling diagnostic tests, etc. You can choose not to provide certain information, but then You may consequently not be able to take advantage of many of Our features.

 

We may also collect sensitive personal data or information (“SPDI”) about You when you use Our Service(s) on the Platform.

 

This information includes health information we receive from You or, on your behalf, such as information regarding your prescription, details of treatment plans and medication prescribed by a Medical Practitioner, dosage details such as frequency of dosage, alternative medication, medicines ordered by You through the Platform, diagnostic results, other health-related information and any other information inferred therefrom. We do not collect your medical history nor store it and use it. We ask you to share your prescription only till the medicines are delivered and it gets automatically deleted once your service is fulfilled. We do not store or use your prescription, medical history or any other records which comprises of your health.

 

We may also collect payment information such as Your payment card number, expiration date, billing and shipping address. By using the Service, You consent to the recording, storage, and disclosure of such communications You send or receive for these purposes. The payment gateway Razorpay may store your payment information subject to your consent and RBI guidelines.  We may also store and process prescriptions, treatment notes, recommendations and other data generated by Medical Practitioners on or through the Platform, and data shared by third-parties such as diagnostics related information; prescription related information etc and may retain such material for our records only for the duration of you availing the Services.  

 

Information from Other Sources: 

 

We might receive information about You such as order details, your details shared with Our partners etc. from other sources including from Our partners, advertisers or third parties registered on the Platform and add it to Our account information.

 

Use of Demographic / Profile Data / Your Information

 

We use personal information to provide the services you request. To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses. We use your personal information to resolve disputes; troubleshoot problems; help promote a safe service; collect money; measure consumer interest in our products and services, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection.

With your consent, we will have access to your SMS, contacts in your directory, location and device information. We may share this data with our affiliates. In the event that consent to this such use of data is withdrawn in the future, we will stop collection of such data but continue to store the data and use it for internal purposes to further improve our services.

In our efforts to continually improve our product and service offerings, we collect and analyse demographic and profile data about our users' activity on our General Terms:.

We identify and use your IP address to help diagnose problems with our server, and to administer our mobile application. Your IP address is also used to help identify you and to gather broad demographic information.

We connect you to the Blood Donors in case of need by acting as a communication channel. However, Medsolu only connects the donor and the seeker and not responsible for any discrepancies.

We will occasionally ask you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like pin code, age, or income level). We use this data to tailor your experience at our mobile application, providing you with content that we think you might be interested in and to display content according to your preferences.

 

Sharing of personal information

 

We may share personal information with our other corporate entities and affiliates. These entities and affiliates may market to you as a result of such sharing unless you explicitly opt-out.

We may share your information with Healthcare providers for consultation purposes, Service providers and partners who assist with our operations.

We may disclose personal information to third parties. This disclosure may be required for us to provide you access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose your personal information to third parties for their marketing and advertising purposes without your explicit consent.

We may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.

In case, we merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business, all the existing Terms and conditions and policies will be applicable mutatis mutandis with the amalgamated entity/ resultant organisation as may be applicable.

 

Automatic Information: 

 

We receive and store certain types of information whenever You interact with Us. We may also receive/store information about Your location We may use this information for internal analysis and to provide You with location-based services, such as finding a neighbourhood person/different app’s utility advertising, search results, and other personalized content. However, we do not receive or store the location of your mobile device.

The IT Act and the SPDI Rules regulate the collection, usage, retention and disclosure of personal information, which is defined under the SPDI Rules as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

You agree that You are providing all information, including SPDI to us voluntarily. Collection, use and disclosure of personal information and SPDI requires your express consent.

You are providing us with your consent to Our use, collection and disclosure of the personal information and SPDI. You may choose to not provide Us with personal information and SPDI, but in the event that You do so, we will be unable to provide you access to Our App to purchase products or provide Services through Our Platform.

 

If you wish to cancel your account and request that we no longer use your Personal or Sensitive information, to provide you Services, contact us {support@medsolu.co.in}. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent, or cancellation of account may result in Medsolu being unable to provide you with its Services.

Our mobile application might link you to other sites that may collect personally identifiable information about you. Medsolu is not responsible for the privacy practices or the content of those linked sites. Our mobile application will link you to our third-party Payment integration powered by Stripe and Razorpay. Medsolu is not responsible for any fraud or malpractices.

 

Security Precautions

Our mobile application has stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to strict security guidelines, protecting it against unauthorized access.

 

Third party tools and software: 

We use third party SDKs in our App. In order to enhance your personal and overall experience some of the tools are used therein.

 

Your Consent

You acknowledge that this Privacy Policy is a part of the Terms of Use of the application and incidental Services, and you unconditionally agree that becoming a User of the app and its Services signifies your (i) assent to this Privacy Policy, and (ii) consent to Medsolu using, collecting, processing and/or disclosing your Personal Information in the manner and for the purposes set out in this Privacy Policy. Your visit to the App and use of the Services is subject to this Privacy Policy and the Terms of Use.

 

Changes to Privacy Policy

Medsolu may update this Privacy Policy at any time, with or without advance notice. In the event there are significant changes in the way we treat User’s personally identifiable information, or in the Privacy Policy itself, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

If a User uses the Services or accesses the Mobile application after the changes are posted on the app, such User hereby provides his/her/its consent to the changed terms.
