What is FMLA?
Basic protection: 12 workweeks of unpaid, job protected leave with benefits in any 12-month period (26 weeks when caring for a specified family member with a qualifying illness and injury incurred during active duty military service)
FMLA runs concurrently with all other leaves (exception for pregnancy disability in California)
How do I know if I am eligible for FMLA?
12 months of service (at any time)
1,250 hours during the 12-month period before leave begins
When can I use FMLA?
The birth of a child or placement of a child with the employee for adoption or foster care,
The care for a child, spouse, or parent who has a serious health condition,
A serious health condition that makes the employee unable to work, and
Reasons related to a family member’s service in the military, including
Qualifying exigency leave – leave for certain reasons related to a family member’s foreign deployment, and
Military caregiver leave – leave when a family member is a current servicemember or recent veteran with a serious injury or illness.
What is CFRA?
Basic protection: 12 weeks off work to care for themselves or their family members with a serious health condition, or to bond with a new child (by birth, adoption, or foster placement).
How do I know if I am eligible for CFRA?
12 months of service (at any time)
1,250 hours during the 12-month period before leave begins
When can I use CFRA?
Employee's own serious health condition
To care for a child, spouse, domestic partner, parent, grandparent, grandchild, or sibling with a serious health condition
To bond with a new child (by birth, adoption, or foster placement)
Qualifying exigency related to the covered active duty or call to covered active duty of a spouse, domestic partner, child, or parent in the Armed Forces of the United States
What is PDL?
Basic protection: An employee disabled by pregnancy, childbirth, or a related medical condition is entitled to up to four months of disability leave per pregnancy.
When can I use PDL?
Leave can be taken before and after birth during any period of time the employee is physically unable to work because of pregnancy or a pregnancy-related condition.
