KKday is committed to protecting privacy and security of your personal information. This Privacy Policy (hereinafter referred to as this "Policy") illustrates how we collect, process, use and protect personal information on this KKday mobile device application ("KKPortal"). Please read this Policy carefully. If you do not agree to the processing of your personal information in the way this Policy describes, please do not use KKPortal or submit any personal information to us. 

Please note that:

• "KKday" or "us" referred to in this Policy may refer to KKday Holdings Co., Ltd. and its affiliates which will provide related services. 

• If any term hereunder involves "representation with a legally binding effect", you agree to use "electronic transmission" as the means of such representation.

1. Scope of this Policy

• 1.1 This Policy applies to all the personal information that are collected by us through the KKPortal (personal information means data related to any identified or identifiable natural person).

• 1.2 Please note that if you link to any other domain or app that is not part of KKPortal, we may not be able to continue to maintain the security of your personal information. You are advised to read the privacy policy of that domain or app before linking to any other domain or app.

2. Legal Basis for Our Collection, Processing and Use of Personal Information

To the extent necessary and relevant under applicable data protection laws, KKday collects, processes and uses personal information pursuant to any of the following legal basis:

• 2.1 A contractual or quasi-contractual relationship exists among the parties, and appropriate security measures have been taken to ensure the security of personal information.

3. Purposes of Our Collection, Processing and Use of Personal Information

• 3.1 The types of personal information and the purposes of our collection, processing and use of those personal information (distinguished by the source of personal information)

  • 3.1.1 Personal information provided by you
    We will obtain personal information that you have entered on KKPortal for a variety of purposes, including providing KKPortal’s service, improving system operations, and informing you of KKPortal’s updates. We will also obtain personal information for other specific purposes as described below.

    • 3.1.1.1 User Data
      For the purpose of authorizing the use of KKPortal, we will collect, process and use your name, email address, your password and your IP address for authentication and account access. 

    • 3.1.1.2 Contact Information
      For the purposes of providing and managing KKPortal’s service, we will collect, process and use your contacts’ telephone numbers and other similar information provided by you to create contact lists on KKPortal.

    • 3.1.1.3 Call History
      For the purposes of providing and managing KKPortal’s service, we will store the time, recipient(s) phone number(s) and duration of all voice call made through KKPortal to provide your call history.

  • 3.1.2 Personal information obtained from a third-party service provider
    For the purpose of providing KKPortal’s service, we will access and use personal information you provided to third parties (e.g., Google) and will obtain your data (such as username, profile picture and email address) through the third parties. 

  • 3.1.3 Personal information obtained through affiliates
    For the purpose of providing KKPortal’s service, we may also obtain your personal information from our affiliates, and add the data to our database to the extent necessary.

• 3.2 Other purposes for our collection, processing and use of personal information
  In the event any of the following occurs, we may also use your personal information for other purposes:

  • 3.2.1 With consent of the parties.

  • 3.2.2 Expressly required by law.

  • 3.2.3 Where it is necessary for protecting public interest, such as when we think that your actions may be illegal, we may provide personal information to the competent authority.

  • 3.2.4 Where it is to prevent harm to life, body, freedom or property of the parties.

  • 3.2.5 Where it is to prevent material harm to the rights and interests of others.

  • 3.2.6 Where it is beneficial to the rights and interests of the parties.

4. Retention Period

• 4.1 KKday will retain your personal information for as long as necessary while the aforementioned collection purpose still exists. Where the purpose of the collection ceases, we will no longer keep the data in a way that will identify you, unless otherwise required by law or the information is required to carry out corporate tasks and conduct our business.

• 4.2 For the purpose of facilitating the service on KKPortal, we will also store certain personal information on our service provider’s systems,which have access control in place. For example, we may store your user data and call history on our service providers (e.g., VoIP providers’ system) for as long as KKPortal’s service is active.

5. How Do We Protect Personal Information

• 5.1 KKday is committed to protecting the security of your personal information. We take appropriate administrative and technical measures to ensure the legality of our collection, processing and use of personal information, and to prevent personal information from being tampered with, damaged, lost, leaked or otherwise infringed.

• 5.2 We will carefully select the service providers we instruct to collect, process or use personal information, and supervise the security of personal information by contractual and other reasonable means. We may allow our service providers to access your personal information for the purpose of providing us with the required services and/or ensuring the quality of services of KKPortal. In such cases, your personal information will be accessed only to the extent necessary and solely for the purpose of our receiving the respective third-party services.

• 5.3 We take reasonable security maintenance measures to protect your personal information from unauthorized access, use, disclosure, or modification. However, please note that no security maintenance measures over the internet or electronic storage are 100% secure, and we cannot guarantee the absolute security of your personal information.

6. The Rights You May Exercise through Us

To the extent provided by applicable laws, you may exercise the following rights with respect to your personal information through KKday:

• 6.1 Access to your personal information, including the right to make an inquiry of or to request to review or make a copy of your personal information. 

• 6.2 Supplement or correction (Depending on the situation, you may need to provide appropriate explanations)

• 6.3 Requesting to stop collecting, processing or using personal information or requesting to delete personal information.

• 6.4 You may withdraw consent you previously provided to us for certain processing activities by contacting us. 

• 6.5 Right to personal information portability
  You may request us to make your personal information available to you in a structured, machine-readable, universally used electronic format, or transfer it to a third party to the extent technically feasible.

• 6.6 The way for Right Exercise
  You may contact us to exercise the abovementioned rights. 

7. Personal Information of Minors

• 7.1 If you are not an adult in accordance with the laws of your location, please have your guardians read and accept this Policy, and your guardians should agree to register you to KKPortal or submit your personal information to us.

• 7.2 If the data you fill in contains the personal information of a minor, you should represent and warrant that his/her guardians agree you to provide such minor’s data to us.

8. Change of this Policy

• 8.1 KKday may update this Policy in the future. You are advised to pay attention to the latest version of this Policy. In the event of a major update, we will notify you proactively in an appropriate manner (such as sending email, bouncing window notification, app notification, etc.).
