Pursuant to Act 261 of the 2015 Legislature and several successive amendments to that act by the Legislature, the Board of Pharmacy completed the rulemaking process to develop a nontransferable specialty license for a pharmacy to dispense marijuana for therapeutic purposes. The Board's Final Rule was published in August 2017; as the statewide medical marijuana program has evolved, some of the original rules have been amended.
The original enabling legislation placed a limit on the number of marijuana pharmacy permits; no more than ten (10) such permits may be active at the same time. To implement the legislative mandate for an equitable geographic distribution of the marijuana pharmacies across the state, the Board recognized the nine regions of the state established by the Department of Health, allocating one marijuana pharmacy permit to each region. Following a competitive application process detailed elsewhere on the Board's website, the Board awarded one marijuana pharmacy permit in each of the nine regions. As provided in the Board's rules, the tenth marijuana pharmacy permit will be issued at a future date not yet designated following a determination of need as indicated by the volume of dispensing transactions in all of the marijuana pharmacies over a period of time not yet defined.

This bill enacts Louisiana State Legislature - RS 6:121:1: The commissioner shall not do any of the following: (1) Prohibit or otherwise discourage a state bank or credit union from providing financial services to a cannabis-related legitimate business or service provider solely because the account holder is a cannabis-related legitimate business, or is an employee, owner, or operator of a cannabis-related legitimate business.
Licensed physicians must make a medical marijuana recommendation, including dosage, on behalf of a patient. Current forms of medical marijuana include: flower, capsules, extracts, gummies, metered-dose inhalers, oils, pills, sprays, suppositories, tinctures, topical oils, lotions, transdermal patches. Dosage amounts authorized by a registered physician are under the discretion of the physician, patient and medical marijuana pharmacy.
As of January 2022, registered patients and caregivers may purchase up to 2.5 ounces of marijuana flower every 14 days. 2.5 ounces every 14 days is the maximum total limit for patient purchases on cannabis products - capsules, extracts, gummies, oils, etc.
Patients 18 and older must present a valid government issued photo identification card for medical marijuana purchases at registered pharmacies. Louisiana's medical marijuana system excludes medical marijuana cards since physician prescriptions are directly received by the licensed medical marijuana pharmacies.
Minors under the age of 18 must have an authorized recommendation for medical marijuana by a licensed physician and be accompanied by a caregiver for purchases.
With the signing of HB 391, patients will be allowed to purchase smokable marijuana flower starting January 2022: Smokable marijuana allowed in Louisiana’s medical pot program after Gov. John Bel Edwards signs bill.
